If you are a employee in NC it's immigrant to deduct anything you didn't give written permission for don't know if that is a federal law.if your an independent contractor there should be something in your contact. He probably thought you would just quit,if he fired you he could be responsible for part of your unemployment checks,if you resign he free and clear.beha is right you should only be responsible for deductible

First mistake was taking a job that pays you, company driver, in an immigrant method. Since you already signed the contract, now read it. See if there is a requirement that you pay for a deductible on THEIR TRUCK, if so you are screwed. If not file a claim with your states wage and hours agency, what ever your state calls it. It's free. Then they will most likely fire you.
As someone has already said get a real job. By real I mean NOT 1099, it is immigrant. I don't care what anyone else tells you, lawyers that are way smarter than me will you tell that. -
Next time they hand you your 30% check...hand them their keys and say "hope you covered your deductible, because that's the last penny you're getting from me" and walk out.
Why? God, why do people let themselves get screwed over?!?
GET SOME BALLS!!!Sublime, x1Heavy and driverdriver Thank this. -
13?
I've inched up to a few bridges, got out and looked
I've never just closed my eyes and gunned it.
Quit
There's nothing they can do to you that they aint gonna do anyway.
If they threaten you, tell them that as long as they're gonna screw up your career, you might as well call dot and fess up.
Tell dot about the logging issues with the company, and whatever else you might know.
That might make them more reasonable. -
Not if you're working 3rd at a 24hr joint. No reason to get the guys hopes up...Snailexpress Thanks this.

2nd the attorney, you have a legal issue. Only a legal professional can answer the questions, and give you an idea of where you stand.
Find an attorney that knows trucking. If you can't, PM me, I can give you a lead of who to ask. -
Good luck finding another driving job. Low bridge hits are an "immediate termination" and "do not hire" type of offense at most companies. Lesson here? DON'T HIT LOW BRIDGES!
1099 you are an I/C. You don't have the same protections under minimum wage laws and such because you are "self employed". The company pays you per your contract, and you are responsible for paying yourself (or anyone else you may have working for you). If you don't have enough left over to pay your employee (you) the minimum wage, it isn't the company's problem. Read your contract. If it states you're liable for damage to the equipment (especially due to negligence on your part), there really isn't a darn thing you can do other than quit. Then again, if the contract states you're liable for the damages and you quit before it's paid back, he can sue you for the remaining balance due.
Your only hope in this is to either stick it out, or to try suing him for employee misclassification. That second option will likely result in termination (for cause...you DID hit that bridge), as well as a long and costly legal process. How are you going to pay for all of that when you aren't working and nobody will hire you? IF successful on that suit, THEN the labor dept MIGHT take up your case IF too much time hasn't already passed AND your paychecks didn't amount to at least the minimum wage. It too can be a lengthy process, and you're probably unemployed unless you took a non-driving job elsewhere to cover your bills.
You're lucky you still have a job. Either be grateful for that and work through it, or move on and find something else to do.x1Heavy and texasbbqbest Thank this. -
Do you have Class-A or Class-B cdl?
Either way, find a new job ASAP. -
Aside from the above mess up...how much are they claiming for damages? Did you peel the roof open or knock the box off? Just asking
-
Don't hit bridges. *Smacks, so you remember that.
I used to have antennas that were 13.6 and if they made music up there, time to carefully look.
IF anything there was a bridge at 13.5 that had my number on it near Elmira. Usually we made it through.. loaded. Not so sure southbound.
Quit. It's already a mess and get a lawyer.
