    I honestly believe the IRS makes up rules as they go - or they're so vague in their wording that you interpret them incorrectly. I talked with 2 different CPA attorneys (one in SC and one in NC) about these sort of expenses and they told me what I post earlier - that you can take the deduction.

    I had my own little run-in with the IRS in 2010 regarding my 2007 tax return. They froze my bank accounts and were about to seize my assets when I hired the one CPA attorney in NC. Come to find out, my mortgage company never filed a 1098-INT form to the IRS and the IRS thought I lied about the $15k worth of mortgage interest I claimed and came after me! It took the attorney & I over 18 MONTHS to get it straight with the IRS. Of coarse, the whole time they held my refunds AND I never got any interest, either. :biggrin_25513:

    It was her stand. One of many. In all my years of tax preparation, I have never ran into such an auditor.

    I will not breathe easy until the appeal is over. I have detailed responses, with revenue rulings, and other court cases that support it. The appeal is the last step.

    In this case they are plain ignoring the revenue ruling.

    Well , I'm an O-O now. So , I've had losses the last two years. And I own rental property and had losses there.
    I use a CPA . She does a good job for me . Finds things , and calculates percentages , etc.
    as for cell phone , my company ( I incorporated ) pays about 80% , I pay the rest. I don't even Try sat. Radio , or Direct TV . Id rather not get on their target list. I take safe deductions . I hope.
    Referring to others posts, this out-of-control government of ours is Desperate for our money. The iRS has carte Blanche from this administration to get all of the money it can , especially from us Evil Business Owners , who don't pay " their fair share " .
    I'd rather lose a little in deductions , than fight a losing battle with the Hydra that has become our government.
    And yes it bothers the heck out of me , not taking deductions I can legally take.
    Best advice I can give , is use a CPA , or Tax Attorney , and ask them what you can write off. And keep Reciepts . Forever. We have boxes of them in our basement.
    Its gonna get worse before it gets better.

    Thanks for the heads up RM. My CPA always gives me those items thru choice along with many more. She actually allows me to dictate just how "loose" or "tight" I want my docs prepared.

    I'm not in a good position to fight a range war right about now so I'm thinking I'll duck a little lower this year to avoid his unwanted attention.
