I do not know what state you reside in, but here in Va. an employee cannot sue an employer if the injury is job related. That is because Workman Comp. kicks in. I was hurt on the job and all my medical expenses were paid, I received 2/3 of my wages, plus no taxes are paid on what you receive as wages under Workman Comp. You will never receive a 1099 or a W-2 form and the checks are mailed to you each week. I was coming out better than when I was working.

It is very unlikely that since you are under Workman Comp. that a lawyer will even listen to you, but it all depends on the laws of the state that you reside in.

My father-in-law was injured in a coal mining accident and for 10 years, up to his death, Workman Comp. took care of him. His daughter, my sister-in-law was secretary for one of the biggest lawyers in Norfolk, Va and his advice was to just take the benefits from Workman Comp because it would be useless to sue.

Unfortunately, not all states have a decent worker's comp law. There are lawyers that specialize in work related injuries. I'm all for "doing the right thing." UNLESS you are being screwed. Then you still need to DO THE RIGHT THING BY CONTACTING A LAWYER. (You have no idea how much I hate to say that. . .)
