LLC or Sole Proprietorship

    Getting ready to start on my own authority. Been a leased guy for 5 years. Currently set up as sole proprietor, should I register for LLC or just keep it the way it is. Maybe down the road I’ll have a couple drivers and maybe a leased truck or 2.

    Just about the same thing. You won't see any real difference until you incorporate.

    I have an LLC but they treat me as a Sole Pro for tax purposes.

    So I’m understanding. Get authority now using sole proprietor then later I can go back and change it to a llc?

    If you are going to do that, incorporate. Then you are not personally liable for the company like you would be otherwise.

    The big difference is that the LLC creates a separate legal entity to protect your assets. If a four wheeler decides to cut in front of you and give you an immediate brake check before calling, “The Hammer” to sue you there is no legal separation between your personal property (house, car, boat, wife, dog) and the businesses property with a proprietorshIp. Everything you have is fair game. Even if an employee caused the accident. With a corporation (even an LLC) they can only go after the company’s assets - your stuff is protected.

    With drivers I would definitely go llc.

    one truck with just you driving it doesn’t matter how it’s separated, if you kill someone everyone’s getting listed in the lawsuit, which would be you as a person and your company

    If you’re a one man show an LLC doesn’t protect anything. If it were me I’d just go sole proprietor until you get to the point where it benefits you to incorporate.

    Talk to your accountant to figure out whats best for you and your specific operation. As you see on this site asking truckers this question gets you a hundred different answers.
