My husband was in an at-fault accident 2 years ago. The company he worked for took care of everything regarding expenses from the accident. He was not fired, but he was cited (improper lane change, I believe). Now, the woman is coming back and suing him and the company for $25,000 for long-term injury, pain, and suffering. In the paperwork, she is claiming he did this with malice and did it intentionally. She is also claiming that he was unfit to operate the vehicle. He passed his drug test following the accident, had an up-to-date physical, and was not texting or doing anything inappropriate. He no longer works for that company. What should we do? Does he need his own individual lawyer as well as the company?

lovesthedrive and ajostlot Thank this. -
I believe the insurance company for the company he was working for should take care of it . They should hire the attorney ...i might be wrong , seek for legal help ...i just heard similar situation and that what was done

If she essentially settled with the company by the company paying all the expenses and everything I don’t think she has grounds to file a lawsuit now because I’m almost certain she had to sign something for the company to pay everything

I'd talk to a lawyer, can't depend on the company to take care of it, especially if he's no longer employed there. If it was all taken care of then they'll have signed away any and all future legal claims against the company, driver, or their insurance. I don't know how legally airtight those agreements are. As I said a lawyer would be my first call.NavigatorWife, ajostlot and bzinger Thank this.

Your husband is named as a defendant in a lawsuit. He needs to lawyer up. PERIOD!

If she got money two years ago from a previous proceeding. You cant milk something again when the money runs out. what ever judge will throw it out and hold her in contempt. Yes he should get a lawyer.
Once a legal matter is settled for what ever reasons. One can not go and redo it again after the previous matter was settledNavigatorWife, Flat Earth Trucker, ajostlot and 1 other person Thank this. -
this would most likely be a civil suit against your husband.
there are usually time limits as to when a suit can be filed against someone.
you need the exact date of the accident.
then seek an attorney, most likely, it'll have to be someone located in the state, where this accident took place.
further, zip up the lips.....what you say can be read by attorneys, law firms, scumbags, and ambulance chasers.
it might be $25,000 NOW...but it can turn into a MILLION dollar suit real quick.....if you keep talking online.bryan21384, John E., NavigatorWife and 10 others Thank this.
