Injured helping another driver

    A week ago I got my truck washed went In Petra for coff an older lady asked for my help to secure her mail freigh that shifted offered to pay I declined kindness. Anyway though she was holding door she wasent and a gust of won’t flew the door and. Now my finger is broken and mail. She drove me to ER my company flew me home I’m a flatbedder can’t work. The way things are looking work mans comp is unlikely to cover me since it wasent my truck. Saw a doctor today my one back split into three pieces I asked how late my til I can work answer uhhh 2 months will need a p ice of metal. Workers comp haven’t made their decision my company any paying nothing but a little sick pay for two weeks and I’m wondering if I can go after her company to cover lost wages and medical bills… no good deed goes unpunished maybe I can sue someone lol idk can’t afford two months off tho

    the last part is not considered a good deed. you choose to take a good deed attempt and turn it into a truck stop parking lot lawsuit. such a shame

    Good on you for helping another driver. I hope you get well soon and get back to work, but I don't see how the other driver’s company could possibly be held legally responsible for this. You might just have to suck this one up.

    This could be used as a lesson though. I’m assuming since you were taking a break you were logged off duty. Something for everyone to think about... how many of us log off duty the second we pull into the parking lot? I know I’ve done it. Well Workers Comp can’t really cover a work accident if you were off duty.

    Not necessarily true. Drivers have fell getting in/out of there trucks when logged off duty and are still eligible for workman's comp. And for other things too.
