    I've been pulled on "random" before during downtime. All that was required was notification of my being on personal time and I was put back for a draw later on. Had it occur while I was working in the patch (cdl position) and also while working at Con-Way who were big at that time about sending people to check suspected alcohol in vehicles.

    I told them I was on home time, the last time I was pulled, it didn’t matter, still had to do it, guess that’s difference of company driver/only one guy on that policy.
    You got 4 hours or it’s a refusal.

    And they wonder why they have shortage of people.
    Treated as a criminal, and everything is because that big stupid truck is holding everything back, I could’ve been home by now...:(

    Something isn't right with that. Cause no where in the FMCSR does it say you have to be sober 24/7/365.

    If your in the truck, it can be after a ten? At home, they shouldn't be able to bother you. But LS called me at 3 pm at home and I had to pee before 5pm. I asked what if I was in Thailand and got this call? I didn't get a response.

    I'd have less than politely told them what they could do with that random while I am not on duty. FMCSA requirements are within 4 hours of being on duty.

    they should inform the ones calling you to do it now, no matter what, then.

    And “Do it now, or I’m writing you up as refusing.”
    That is threatening your livelihood and giving me mental anxiety.
    I should get a lawyer...

    They shouldn't do alcohol while on home time. Even if they did. As long as you didn't drive to the test and are not going to be driving till after the alcohol is out of your system. They can't violate you. You're legal.
