Improper use of personal conveyance violation

    Got a level 3 inspection in Colorado. Passed everything then the inspector combed through my ELOGS and charged me with Improper use of pc. No points, but wondering if this shows up when I apply for jobs. Very concerned as I’m applying for cryogenic jobs and they want squeaky clean records. Tia

    That sucks. Explain your usage of PC. I know they want it to be non dispatched, non work related including mechanic, truck wash or anything regarding maintenance. When I use PC I note in my log specifically why I'm PCing.

    How did you use the PC, and how old was the entry in your logs? If it was older than 7 days, he wasn't supposed to be looking at it and you should be able to get it overturned.

    Its not a moving violation, should be no points. You should be good. check your dac, hire right,dmv... if its not on there it never happened.

    It's around 7 points or more if the cop decides to be a D about it, HOS violations carry a lot of weight because it's the one law most drivers like to break.

    Your only recourse is to lawyer up and try to fight it, but only OP knows the circumstances and if it's worth it.

    It never showed up on any of my records, Maybe you right, it might depending on how or exactly how it was written up. I used it to go home, about 30 miles, which happened to put me 30 miles closers to my next disaptch, I was not under dispatch, wasn't dispatched till I was at home for 10.5 hours. Anyway the officer said I was advancing my load.

    If you didn't know what you were picking up or from where, then it couldn't be advancing the load...if you knew, but weren't dispatched, then it can be considered advancing the load...but the burden of proof is on the officer.(like a prelan message on the box your ELD is on, and you allowed him access to the messages)

    So even though you weren't under a load at the time and was assigned your next load after your break he ticketed you for advancing a non-existing load? Couldn't you just show him the assignment dispatch time stamp vs when you arrived home under PC?

    Doesn't matter how we think about it. In the guidance that allows pc, it specifically states returning home from a receiver is not allowed. The reasoning is dot sees it as part of the whole trip, thus dispatched.

    May a driver, who drops his or her last load at a receiver’s facility use personal conveyance to return to their normal work location (i.e. home or terminal?)

    No. Returning home or to the terminal from a dispatched trip is a continuation of the trip, and therefore cannot be considered personal conveyance.

    I used PC to go from the delivery to Walmart then the truck stop then return to get an empty the next morning. The company says it's OK but I'm not so sure, now after reading this.
