My husband has only had his Class A for 6 months. Working for a small company who would not get the driver headlight fixed. He got pulled over. And got a fix it ticket for the light BUT also was ticketed for falsifying log books/ failure to maintain accurate log book and was told to be out of service. He waited 5.5 hours to get unloaded and didn’t log it correctly so he was driving while ‘off duty’. Is he out of service for 10 hours or longer? And how badly does this affect him? Its his first time getting pulled over while trucking….

Yes, hes out of service for 10 hrs, and send the inspection report to the company, if theres any fines associated with it, company pays (or should pay) equipment violations and rectify the issues, if they dont, its time to move on

A slap on the wrist. He just needs to be more diligent with the logs.
So they told him to park it. Ok, notify the DM and tell them that DOT wants the headlight fixed. Tho how much is it for a headlight? I am sure the company is wondering why the driver cant replace the bulb and send them a bill for the bulb + labor.

Some thoughts! First what kind of driving is the "husband" doing? Your question sounds to me as if the "husband" was running paper logs. I am going to stay out of this because I never used ELDs and won't go there. Getting charged with false logs is one "if not the most" serious charge a trucker can be charged under the current HOS rules in part 395. Back in the old paper log days, many drivers got tagged with "form and manner" mistakes. I don't really have enough information with regard to the "husbands" HOS status so I will just say this. A form and manner mistake that can be corrected that is just limited to the current day should NOT result in being placed OOS! This is clearly covered by 395.13 (b) (3). It does NOT mean you can't get a ticket!

First. He shouldn't have moved with the headlight out. Typically the driver replaces that while at a truck stop. Then sends in the receipt to get reimbursed. If his company said they wouldn't cover it. He needs to get away from them.

It's not very helpful now but on ELDs you can't drive while Off Duty unless it's Personal Conveyance or going to first safe place to park if a driver runs out of hours while loading or unloading. Same rules apply to paper log books.
If sitting and waiting to load or unload you can log it all as On Duty or you can log say 30 minutes for loading or unloading and then go into the Sleeper and rest for the rest of the time a driver is waiting.
You can't run paper log books anymore unless the truck has a 1999 or older engines. Those older trucks headlight should be pretty easy to fix. You might need a special screwdriver. The company should have paid to fix it or let driver buy the light and fix it himself. Lots of new trucks today have LED headlights and can't be replaced by the driver or they are crazy expensive but the should also last life time of the truckBlaire0308 Thanks this. -
Rookie mistakes. I would have refused to drive the truck out of the yard if it didn't have a working headlight. Alternatively, it takes less than 10 minutes and $20 to pull over at a truck stop and change a headlight bulb. Probably less than $100 if you let them do the work. A bargain considering the time and money he's losing because he didn't.
Be thankful this didn't happen in Mexico's Gay District (some of the old-timers still call it, "California"). Logbook (and hazmat) violations can mean JAIL TIME for the driver there!Last edited: Sep 14, 2021
