Mmmmmm that's a tough one..you gotta buddy? Get them to call your company, and act like they want a job, get him/her to ask those questions. Beef it up real good though, make it seem like they have all these issues and they will spill the beans. If they don't report to DAC, to hell with them...cut your losses and get out of dodge. I don't normally endorse leaving someone's equipment out there like this, but if they aren't going to take care of you, what are you worried about them for? You don't want to drown yourself waiting too long for your company and broker to mess up your life.

I think my solution is that if they send me back on a plane to get another truck to complete this load, that they would have to put it in writing that this would not be put as an abandoned load. But I really don't want to touch another piece of their equipment ever again.
I have been in four trucks at this company and two have broken down. The other truck was my trainer's truck and I hadn't yet driven it.

    No. I'm 1099 not o/o.
As for this being my fault. I have never had a transmission fail, so I didn't know what the heck that noise was. But what did happen is that the head of safety and the vice president told me that it wasn't severe and that I cannot go to a shop. That I had to take it all the way and even on a further load.
Since I had been at a shop less than 24 hours before this event, and was told that the truck was fine, I was out of that range of knowledge to determine what was happening. I've driven at least 100 trucks in my life and never had this experience.

So you’re an illegal contractor then. Why does an employee have an escrow? I wouldn’t even call them back. I’d get a job somewhere and that would be the end of it. A real job not a 1099 contractor. Go to Walmart get a new phone and number throw the old one in the bottom of a deep lake and move on.

The dac is not the end all be all. Many companies have stopped reporting to it. I know for a fact jbhunt stopped a year or two ago.
    The biggee is equipment/load abandonment.
All we can do is make suggestions. You can't make these clowns do anything. Surely there is a limit on how long they can hold you captive before it no longer matters. With email and text evidence you can show a prospective employer that you made every good faith effort. For the love of Mike never never never go 1099 again.

Let's check with @Chinatown and see if he has any suggestions of a company that may be amenable to accepting you and shipping you out of wherever the heck you are to orientation.

    Man I'm feeling your pain!

So you took a 1099, that's an illegal way to pay you and are surprised they pull other illegal stunts? What else did you expect?
Here's a clue. You are loosing more money than the escrow. That money was gone the moment they illegally took it from you and you don't protest. Now your options are to continue to let them screw you or move on and get a real job that is actually legal.

If they send you to get the truck to complete the load, and you get in the truck, your best course of action would be to go ahead and deliver. However, they need to know of your intentions asap once you get there.
