Hirschbach threatens to file lawsuits to keep drivers from leaving

    I left the J.B. Hunt nightmare decades ago while still in training - never paid back anything. In fact, I threatened to sue them because of the horrible and poorly qualified OTR trainers they kept around. The common 'qualities'? Males looking for sex with other males. Same males couldn't bypass an adult bookstore, truck stop restroom/shower and/or rest area restrooms. Then masquerade as 'The Terminator'.[​IMG]

    So companies lately seem to specify the training repayment period in miles not months which, obviously, if dispatch doesn't like you or is inefficient, can mean several years of being stuck with a low paying carrier.

    Also, while a contract is a contract, it's not like these companies are taking steps to confirm the drivers read and understood before signing. The companies probably prefer the advantage they get from drivers not fully understanding the relationship they're entering into, and ironically get p%#@ when the same driver who didn't care enough to read the contract doesn't care enough to honor it when it no longer suits them.

    Both sides are screwing the other and this is routine in our industry. Sure, the driver owes 6k (the average it seems) in "legitimate debt", and the company can have fun trying to collect even a fraction of it!

    What makes them think they can threaten another company? The contract is between hirschbach and the driver. So the way I see it, they can go after the driver if he/she quits...they have no legal right to stop a better company from recruiting their driver.

    If I worked at a decent company, would recruit and hire that driver If he/she was worth it, and then counter sue hirschbach and put them on blast for their evil tactics.

    Looks like fear and intimidation is the only tool that big bottom feeders have for driver retention.

    Great thread. We have a threatening letter, contracts, a constitutional debate, an allegation and defense of Stevens Transport, and an 8th circuit decision.
    IF that letter is real, I think it is simply an attempt to get the prospective company to move on from that driver in a we don’t need that hassle kind of way. One of Hirschbach’s problems is they have no way to prove the driver was not going to pay the obligation. They have no legal recourse until the default happens.
