    Shouldn't the driver have been able to stop in time if the headlights were adjusted correctly? I don't know. I've never been driving at night and had a car parked in my lane with its lights off.

    Are you asking rhetorically? Werner has already been burned by allowing what seemed to them a "slam dunk case" go to a jury, to the tune of $90 million. In that case, a 4 wheeler going the opposite direction on I -10, lost control during a ice storm, came through the median and hit the Werner truck head on, killing an occupant of the 4 wheeler. The Werner driver did nothing wrong, but be at the wrong place at the wrong time. He was a new driver and the plaintiff claimed that he should have never been there. The jury bought it and sided for the 4 wheeler.

    Fault really does not matter anymore, It only determines how many zeroes a trucking company is going to put on that check.

    Disgusting. Absolutely disgusting. If anything the driver should be compensated. They have to live with the fact they were involved in a crash that killed 2 kids due to the stupidity of someone else.

    Because our tort system is broken. There have been two nuclear verdicts in the last couple years where the truck driver did absolutely nothing wrong and the fault was completely on the driver of the car. The argument was basically that the truck shouldn't have been there in those two cases because of the bad weather. And the jury bought it.

    The Parents should be charged with negligent homicide. What a tragedy. My heart goes out to the Werner Driver. What a bunch of BS.

    then for sure, you never drove up to the GWB , go thru the toll plaza, and get to the first overpass........(this was after 1 AM one time)....

    it'll scare the you know what outta you, like a Werner trainer did.....

    The more i see cases like this and after the experince i had the more im considering just hanging up the keys. At the rate things are going some ####### is going to get plastered and do a head on with my rig in a truckstop and ill be liable for millions because i shouldnt have been there.

    Its really getting to the point being a driver is just not worth the risks of being a driver.
