I'm not saying that you were in the right for using your phone. That is one of my pet peeves. But what evidence did he have to issue you a warning? I just can't see not being able to fight something that will cause damage to your business or reputation. To me, it is just the same as libel. I'm sure you can get a lawyer to fight this. Of course, if he DOES have the evidence...

He's not fighting. He's suing for libel. He sends a demand letter to have the incriminating info removed. This is assuming that the cop doesn't have evidence. If he does, then yes, he is SOL. If the cop doesn't have evidence, then the gloves come off.
