Ron, remember that any and all reasonable expenses get added to the bill. That would also include any cost to repair the unit to the condition it was at time of sale. While I am sure the scum will never pay. At least you can file the legal paperwork and get a judgment against him. Once that is in place, file leans against any and everything the guy and the company owns. If it’s real estate that’s even better. File a report with the credit bureau as well, just keep the report to base facts.

 

I will be working through all of that in the next few days. I have a lawyer on retainer in Oklahoma to consult with (her was to file my writ of Replevan- no longer needed). The question will be what jurisdiction to file in. The contract is have an Arizona adjudication clause - he is likely to be served in Oklahoma if at all and legal residence is in West Virginia.

I will do my best to pursue this but bottom line the collateral was the huge deal.

I am guessing that this was a sale by your business. The business is in Arizona. I do believe that it would be Arizona jurisdiction. Hopefully you did this as business to business over personal. Then you can go after the business.
