What does your carrier contract say about detention pay disputes?

    Getting ready to fight a denied detention claim but want to know what I'm up against first. I have timestamps and camera footage showing arrival/departure times but the broker claims my documentation is not sufficient.

    I reviewed my contract and its got a lot legal language about arbitration and dispute resolution.

    For those of you who've actually looked at your carrier contract - what does it say?

    Can you take your company to small claims court or are you locked into arbitration? Any clauses about class actions being waived? What's the actual process supposed to be for disputes?

    Trying to figure out if it's even worth fighting or if the contract basically makes it impossible to recover anything under a few hundred bucks. I know carrier contracts vary but would be curious to see some example of people that have resolved their disputes successfully.

    im gonna say read your contract.
    trying to get paid detention from some shippers/receivers is a pain.
    Hills pet comes to mind.
    You, the one held there can not get a form that used to be available at guards face checked you in at what time, nor can you contact whomever at their office.
    The trucking company has to contact whomever they got load from, they have to contact hills, hills says yes, or no, then tells the shipper, when they get off the ball they inform the trucking company, who jay or may not info the driver. It’s just surprise if you get paid.
    Expect to wait 4-12 hours. (Emporia location)

    Get a lawyer, have them read through it and tell you. If you ask here, you need to name the company and provide details of the situation.
