In regards to company drivers, who exactly are you accountable to in your company, and who has the authority to fire you? Is it the fleet manager? The reason I ask is because when I read about drivers experiences with dispatchers/DM's (or whatever they are called) and the DM's threatening drivers about being fired if "they don't do a run", etc., I get confused about what exactly is the dispatcher's authority over a driver? If the DM messes with you i.e. punishes you for refusing to do them a "favor" (that would cause you to break HOS rules) by making you sit, who do you complain to?
I know you can complain to Safety if the DM tries this; but what happens if you complain to the Fleet Manager? Will they back the dispatcher for trying to get you to run illegally? This is the biggest concern I have with getting into driving:dealing with either incompetent or downright "I don't give a s*** about you" DM's who will try to punish a driver who won't run illegally, or will jerk you around on your home time.
Who exactly IS your boss?

I am the BOSS! Just don't tell my DM, I like to let him think he's running the show.
Your really stressing out over the wrong things, theres plenty of other stuff to worry about. If you find yourself being forced to run illegally then you need to quit as there are plenty of companies out here that do it legally. I've known about 20 DM's in my time driving and most of them have been real good people. Knight had a couple of dchebag frat boy punks but still even most of Knights staff was appreciative of the job we do. By running hard and getting the job done you make their day easier and they do have the ability to compensate you for that. An extra day at home, plenty of miles, or maybe avoiding that "one" customer that no one likes to go to.
I've never been forced to run illegally so I can't help you much in that area other than telling you it's not worth it.Everett Thanks this. -
In the two companies that I've worked for, the safety department could fire any driver that gets into accidents, too many log violations, speeding tickets, etc.
The division manager, who is usually in charge over several dm's, can fire you for too many service failures, too many claims from OSD related incidents if the driver is at fault, too many customer complaints, etc.
So it's like the driver has more than one boss depending on how the company operates. As far as someone in the office threatening your job if you're not willing to break the rules, I just see it as an intimidation technique to see how far the company can walk over and take advantage of a driver.
Drivers just have to have some balls!Last edited: Oct 18, 2010

Thanks everyone. I understand I can be fired for errors, accidents, delivery failures, etc., due to my own fault. My concern was regarding a dispatcher who tried to intimidate a new driver into doing something illegal and if a division manager/fleet manager would side with the dispatcher. I believe I can handle a dispatcher, but I would like to have someone watching my back when I do deal with a dispatcher (in a professional manner, mind you) who IS trying to intimidate, threaten or sweet talk me into running illegally, I tell them "no" d/t no HOS time, and then they try to punish me later by refusing to give me miles, etc.. By reading this site, I know to do all my communicating via qualcomm whenever possible to prevent those "he said/he said" situations and to cover my as....urr buttocks. Thanks again

It does vary by company. But remember this, with ANY company, there are going to be times where you have to dig in your heels and stand your ground. If you do it diplomatically, it should not come back to bite you. And if it does, then you are working for the wrong company.
