    I wonder what became of Mr Muthee? Muthee sounds Kenyan, maybe he fled the country. Can't say I would blame him, honestly can't say I would.

    I need to make clear one point. The original link is to the presiding Judge's opinion. It's not a transcript of the spoliation hearing.

    If you're willing to accept the Judge's analysis and conclusions as accurate, you're in the right place. If you want to read and analyze the transcript verbatim, you have 3 choices:

    1. Visit the courthouse and read it.

    2. Contact the court's clerk or reporter and pay for a transcript.

    3. File an FOIA request and they'll send it for free but it will take longer.

    You know in today's day and age with EVERYTHING on computers- everyone knows every step you take ( esp in the truck.....or going thru tolls or what ever...) and as I read the transpired about the QC information I was like huh?:scratch:
    You can't just ''make'' stuff disappear of have discrepancies like that. You know what they say about stuff in cyber space-once it's out there it's out there....forever.

    Knight has a long battle ahead of them. As someone posted earlier- I am surprised they did not just throw the driver under the bus and be done rather than to go to all the trouble to (as per I read the transcript) cover it all up. I hope they get fined up the whazoo! or worse!

    I'd say it's safe to say if Muthree backed into you in a truck stop parking lot, he would run. He ain't nothing but a coward in my book.

    Knight had the chance in the beginning to stand up also and cooperate. They wouldn't be in the position they are in now. True colors shining at their best. You might manipulate drivers and get away with it. But you ain't going to manipulate the courts. Pay up and suffer dearly. You deserve it.

    I'd say he was Knight Refridgerated. US81 is a regular traveled meat hauler route. I run it countless times. If so, most likely he was hauling Tyson or John Morrell coming down US81.

    Obviously they are culpable. Why else are they dragging this stuff out?
    It has been 4 YEARS since this incident happened. What are they trying to hide???

    Agreed ! And this is so unusual for a carrier to try and hide this......like everyone said, they would throw the driver under the bus normally.

    Did I read that right? They found flesh on the truck out in Cal ? If that's true, Knight is done. One hair, one piece matches the deceased and it's over.

    Oh and there is a reg. or something ( need to ask D.B. ) that keeps a carrier from folding up and opening up under a new DOT # tomorrow. My safety guy spoke of it once or twice.

    Regarding Muthree Mobutu fleeing the country...... not a problem. We had a Miss Tata leave her daycare to go shopping in Houston and it caught fire and 3 babies died. Miss Tata fled to Nigeria and the U.S. Marshall's hauled her back. Well done Marshall's! Bravo! Now go fetch Muthree Mobutu back !

    unfortunately it is amazing just what money can buy---knight will shell out big time---but will still be going strong--muthee on the other hand might as well play russian roulette with a clip fed pistol

    One thing I find interesting in this thread is people saying Knight should have thrown the driver under the bus, or something similar. There just has to be a reason why they tried to cover this up rather than do that. Why? Because it is STILL THEIR TRUCK and THEY HIRED HIM. Therefore, financially, they are still responsible for whatever damage he has caused.

    One other thought here. I can just hear the screams of some on this board if Knight had "thrown him under the bus."

    This is truly a lose/lose situation for Knight. No matter what happens, they are going to pay out huge bucks on this. But don't think for a minute that it will put them out of business, because it won't. Not just this one incident. Now PERHAPS, if there were numerous back to back incidents that were this serious, it might.

    But whatever happens, you know the Knight family has a big cushion built up, and this will have very little effect on them.

    Not completely true. If he "ran" and the company fired him as soon as they found out, they would have been very limited in being held accountable. But since they covered up (knew) he was running way over on his hours, running illegal, they somehow thought it would have been a great time to start doing even more illegal acts (Qualcomm deleting? Changing the tires? Hiding the truck?) They stopped being duped, and became accomplices. Not only did they become more that just accomplices, they became active in a cover-up of a crime.

    A major crime.

    A big friggin' crime now.

    How big?

    They have made the step from Accessory, to Accomplices, and the sheer number of people involved in this case can push it to conspiracy, and since the action was illegal in the first place...and....could it fall under the RICO act as well?

    Fraud and obstruction of justice....
