    You're screwed :yes2557: . My carrier got nailed that way last year . We were on paper logs and they looked good . Then the auditor asked to see Blackberry records . A lot of logs didn't match Blackberry GPS locations .
    All our drivers had to take online HOS classes .

    Call me crazy, but more important than the times a person works and sleeps is the position they sleep in. Most people sleep in their bed at home, the bed is oriented the same way for months even years at a time. So they get used to sleeping with their body turned a certain way in relation to the earth's northern magnetic pull. Truckers don't typically think about this stuff and pull into the first available spot and jump into the bed. What happens if you point your truck all over the compass during the week, you don't get good restful sleep! Even a dog will get up and turn a few times before dropping down for it's sleep time. The dog is positioning it's head towards north. I have been experimenting the past few weeks with pointing my truck east every time for my 10 hour breaks so my head is pointing north. My sleep has improved vastly. The one time I pointed south I tossed and turned for hours. It's the Feng Shui way.

    It's not just someone's word against yours. It's your electronic fingerprint as well. Split sleeper berth, but decided to go into the truck stop for the bathroom 6 hours into it? Thought you were savvy and bought a burger and fries before returning to your truck, used cash, etc, they got you on camera. Some companies have wired the hood to know when/if you opened it for your pretrip. Opened your hood 7 hours into a split sleeper berth? Busted.

    Its always a chance that we take if we have to push the limit. usually as long all the fuel etc... match up everything seems to go ok during our dot audits, we only had 1 in the last 5 years. The 1% comes in to play if an accident occurs, then everything done in the past does'nt matter, what matters is that you were supposed to be there at that time. Not before or later but that exact time.:biggrin_2556:

    So help me understand this. THE auditor requested and was granted access to the driver's personal phone records? I can understand it if the company provided the phones, but I do know that the the CMV, interstate commerce no expectation of privacy, does not extend to personal space, like closed briefcases and telephone records.

    However a real simple solution to avoid this is to disable the GPS on the phone. This has been shown, proven, tool that perverts use to track, stalk children. I won't post all the details about that in this thread.

    I don't see how the DOT could gain access to driver cell phone records. The only thing that they should have access to are driver logs, fuel receipts and other records that the company is required to keep on drivers, such as drug tests, etc.,

    Unless there was a serious accident involved then phone records are non of the DOT business. Especially if the phones are personal and not business owned.


    Was chatting with a couple of our drivers that were over the road but came down to local a couple years ago. They were saying that if forced on elogs then they would either request to go back OTR or jump ship to another company.

    The boss would have to hire more drivers and buy more trucks or force us to share trucks. Now I don't have a problem sharing a truck as long as it is a day cab or a truck that I will never have to possibly sleep in. But we have some real slobs for drivers and I don't want any of them in a truck that I might have to sleep in. It would take me a day or two of cleaning before I would even consider sleeping in a truck and that would also include replacing the mattress every time.

    See the boss loaned my truck out once. One of our drivers was having truck problems and did not want to take a day or two off. I was down for a couple days so the boss let the driver take my truck. They driver spent two days camping in the truck. Rather then strip my bed down, he decided to use my bedding, pillow etc. He was a pig and a heavy smoker that refused to roll a window down when he lit up. I don't have a problem with smoking as I smoke myself, but only in the cab with the window down and not in the sleeper. My bedding reeked of smoke when it got back and you could see greasy stains on the pillow and bedding. Also he just could not grasp the concept of the garbage can that I had behind the passenger seat and threw his trash on the floor and did not pick it up. He also refused to remove is filthy shoes before going any farther then the drivers seat and tracked mud and dirt all over the sleeper etc. There were seed shells all over the floor and cig butts all over the floor, even in the sleeper. The prick also tried to take my CB radio (connex 4300HP).

    I was scheduled for 5 days of camping running out of Manitoba. When I got to the truck I was very upset to say the least. I had to strip the bed, 409 the whole cab, vaccum and run back home (10 miles) for fresh bedding. I then had to track down the driver to get my radio back. He thought it was a company radio, and being a newer driver I did not need an expensive radio and just told me to go to the truck stop and charge a CB to the company. I told him that the company does not buy 300+ dollar connex 10 meter radios and that that was my personal radio. I then had to get the boss to tell him that he had to give me back the radio or else. After everything was clean etc, I walked into the office and pulled the spare key off the board and put it in my pocket. The boss seen this but did not say a word and that was the last time anyone used "my" truck.

    I ran elogs for the first time with my last company and I have to be honest, I loved them! I didn't have to worry about updating them and this that and the other. I just drove. It was really nice. I run legal so I don't have to worry about being over on my hours anyway. Or I should say that I have been really lucky and I haven't been faced with a situation where I would have been.
