I have looked at this post now for quite a while. Pardon me, but it don't make any sense too me. I know several people with open container tickets that are truckers. In relation to the big no go tickets like DUI and reckless driving its minor. I would even be surprised if it is even considered a moving violation in every state. According to your information you have went through school and a carriers check then was let go for what is considered a minor violation? Something tells me there is a lot more to this story so all I can do is ask you to tell us what really happened so you can get good information on where you stand. When new members come in here and their first postings contain the word fired or let go in relation to anything associated with drugs or alcohol, and the posting don't make any sense like your does my gut tells me there is more to it.

Next time use a soda bottle and not a beer bottle. Problem solved. Yes, you should be able to get the OC removed from the license. Otherwise be forthright when talking to the recruiter. Let them know what happened. As long as the company knows beforehand you should be alright. It is when a company makes a discovery of NOT telling them about something that can get a driver dismissed.

I think you just might have hit it. Then it all makes perfect sense. I hope the OP comes back and clears this up.

Thanks for the replied. Yes, looking back I would have definitely done it different. I was let go, not fired. I was informed that the company put rehire on my dac when the ticket is cleared. I have ordered my dac to see what is actually on it now. My former post is all true, I always put true info in my job apps. I have a copy of my MVR that I use. the 2 tickets are what is on it. No arrests. The OC ticket is a misdemeanor and after 3 years is cleared for insurance purposes. To get it expunged I have to wait 5 years in Louisiana. I will check with a lawyer but all the info I have seen doesn't look good. Once you pay a ticket there is no going back, its on your MVR.

Your talking about an open container ticket like it was a DUI or Reckless driving offense. An open container ticket by itself is not an automatic bar to employment even a relatively recent one. It is just not that serious of a charge. You either failed to disclose the ticket and got caught or there is something deeper at play here. I have a very good friend in a carrier safety dept. I asked him this morning about open container. He told me it is not considered a problem by the company or the insurance company as long as it is not associated with a more serious offence. His example was like failure to maintain lane. On the surface it is not considered serious unless the reason was you were drunk. Your holding something back I sense it. However it is your life and business. I'm out of it!

I've posted this before on another thread but I got a Open Container less than a year before I got approved from Road Masters and hired on with Werner. Spent 18 months there and went to 3 other companies before settling down here at my 4th. Shouldn't be a problem.

This thread is 2 years old. What part of I am out of it are you having a hard time understanding. Those were my last words in regard to this thread in 2016 and is still my position in 2018.

It would have been easier just to say what company it was or not reply at all. Who cares how old the thread is
