Yep. I wouldn't sign that contract. NO WAY! When I was a younger man, I might have waited for the 'abuse' to occur. Now I look for the 'indications' of what's to come. There was no reason to put that in the contract. The old contract clearly stated, if the driver screwed up, he/she pays. And I'm fine with that. Thats reasonable. But I have no control over who Mercer selects as customers and if I am to bear the risk of nonpayment, I want to be appropriately compensated for it.

For the life of me, I can't understand why they would put that in the contract. It goes against EVERYTHING Mercer stands for!

I don't know about giving money back but maybe changing how it's paid. There was a load that had some layover money in it. I talked the agent into breaking the $500 out as $200 for 100% loading, $200 for 100% unloading and the last $100 as layover. He warned me that LS might catch it and make him change it but they never did. Simply put, that puts $400 straight to me ay 100%, and 73% of $100 instead of 73% of the $500.

The only other money that a BCO might not see is detention. They won't pay the BCO until it is collected. Line haul and FSC, etc. all pays normal but detention is held back.

Agent charged the customer the old FSC from the previous contract and it was suppose to be new.. I ran the first load of the contract and turns it it was a $100 difference from the previous contracted rate to the current. LS Took the difference out a few weeks later. Went round and round with LS about it and said it was honest mistake and had to pretty much accept the fact...

Landstar takes a percentage of your layover pay that was negotiated and agreed to with the agent??? How can they do that?

It depends how it is broken out on the freight bill. They get a percentage if it is listed as layover, but not if it is listed as detention, 100% loading, 100% unloading. When you book the load you have to make sure to ask the agent to break it out in your favor.

    Hi Folks
i have 4 years of OTR experience. 2 of4 i am owner operator (worked with dryvans and reef )
now i pull overweight containers in Chicago`s area with 50-60 miles radius from rail yard in Elwood Il
i sleep every night at home 98% of cases , 5 days per week . average weekly mileage(220-400 miles per day ) 1300-1700 per week with avg rate 1,47$-1,57$ after all my expenses (i put in pocket)
    my avg check is 2100-2500
my questions are -------Does it make sense to go in LS ? will i have opportunity to make more money with them ?
i never used Electronics LogBook ---- does it make problem ?
what should i expect if i`ll sign in with them ? which trailer better ? is it hard to drive truck and to be self dispatch ?

Not everyone is good with the money. Some guys spend the money before they get a chance to earn it.
