Okay so to put everything to rest I went through the DOT hours of service in the safety manual. According to DOT any time spent at the driving controls of a commercial motor vehicle in operation is considered drive time and has to be logged on line three. There is no rule in DOT regulations that states you can operate a commercial motor vehicle on private property without being in driving status.

Make a note of when, where and why the violation occurred. If your safety department calls you about it, explain it to them in matter of fact terms. Dont use ten words if two words is all that is needed...dont dig your own hole. There was no malicious intent on your part to violate the H.O.S, in my opinion, hopefully your safety dept will feel the same way.Learn from it...and move on.

I am surprised that they dont regulate drive time on private property. You say you can drive drunk on your own private property? Hmmmm how come I cant shoot Deer out of season on my private property? haha

So if you arrive at a truck stop just in time but have to drive around looking for a spot. That is not a violation? Would that be on duty still?

    Can't stress that point enough.
Just something simple like "No parking readily visible, drove to rear of lot to find available spaces." and leave it at that. Don't admit that you went over your 11 hours for the day since that admission could potentially come back to bite you down the road.

They might send him a nasty gram on the QC but other than that, nothing to see here.

I think your best course of action is to leave the country for a few days until the heat is off your trail. Do you have any relatives in Sicily that can take you off the grid for a bit?

I would log it that way. Many times as soon as I hit the lot I log on duty for my post trip.

Google Edmonds vs. Otsby, theres a whole can of worms there if you want to open them.

    Any questions?
