I was ableto download a pdf copy from 2013 off the FMCSA Notice of Claim website, this is just one example of a carrier's fines for log falsification.

It's not the DOT anyone needs to worry about so much but yes they can ticket you for log falsification.

Who you really have to look out for is the bloodsucking lawyers after a fatality crash. They will go through the driver's logs with a fine toothed comb. If they see a pattern of 10 hours solid sleeper breaks, or a pattern of no sleeper time, these will raise questions.

Finally when you are called to the witness stand and sworn to tell the truth the whole truth and nothing but the truth with your hand on a stack of bibles, are you really going to keep the lie alive up there in front of god and everyone? Or are you gonna break down and tell the truth, yes I got out of the sleeper for 22 minutes to go pee three days before the fatality crash and did not log it as off duty properly and I have a habitual habit of log falsification going back decades because I believe the rules don't apply to me.

For you 70/8 drivers (Meaning 70 hour limit for 8 days working) who have sleepers think about this little concept.

FMCSA has allowed you to work 70 hours in that 8 day period. The #1 most important thing they want you to do in that 8 days is rest. This is why they require 80 hours rest in 8 days. They are extremely interested in how much rest you got/get in between driving shifts. So if you have a sleeper they want to see you logging time using it, otherwise showing proof you stayed at some hotel or gf/bf home.

    Winner!

Even an elog recorder will not change your duty status unless you sit there for a certain length of time. Same setup. If elogs wont catch a splash and dash, how can you be falsifying logs?

Just asking. What makes you an expert. I am a expert accident reconstruction expert because I have record and it is on file on SC where a court rendered me an expert.

No, your an expert in hyperbole. As I said before that hotel receipt thing is 100% MYTH. When you go from line 3 or 4 to line 1 or 2 or visa versa you MUST log the change of duty status before you put a CMV on the public roads of this country. you don't log a change of duty status to go potty. Its NOWHERE in the rules.

Flag it and write the minutes below location. I hate to do that, because it messes up the math.

I have been through several Swift logging classes. They teach the 100% legal way to record your record of duty status (RODS). They warned us about logging too much time in the sleeper due to officers busting drivers for falsification when they admitted they got out to go pee sometime during their 10 hour logged sleeper time.
