    Yes, one naïve DOT officer does not make it the law and the only way DOT could have known he was in his sleeper if he had his curtain drawn is if he was stupid enough to admit it.

    Let them invade my privacy without cause to catch me in the sleeper and I will pay a few thousands of those tickets with what win from my lawsuit.

    I see no reason to ever log sleeper running solo and I haven't for years without any issues.

    Here is another one directly from fmcsa which says you may not log off duty while in the sleeper which you all have been asking for proof.

    Here's a quote

    Question 26: May a driver record sleeper berth time as off-duty time on line one of the record of duty status?Guidance: No. The driver’s record of duty status must accurately reflect the driver’s activities.

    I enforced law for a living. Post all the fmcsa crap you want to but that isn't the officers interpretation of it.

    You are only supposed to be able to get a log book violation when you are "operating". I could personally care less if you got up and went to the bathroom during your 10 hour sleeper beerth time. I know i get up at night to go. Also an officer is not allowed tk disturd a drivers rest so unless there is a serious problem they should never be waking drivers up at a rest location regardless if it is a truck stop, on the side of the road, or any old parking lot. I will never be the obe to cause someone to get up and disturb that sleeper or off duty time. Once you start driving then i start doing my job. I teach officers all the time to leave trucka alone that are parked.

    Another way of looking at it is this. Your current status is what is most important. If you went over your 11 or 14 5 days ago but you are current when stopped it is a violation that will be noted on the inspection but will not put you OOS. It is only a potential OOS if it is the current driving period or you are over your 60/70.

    MY GOD your not going to give this silly thing up are you? That question has absolutely nothing to do with your silly HOS interpretation. It means if you are in a truck and it has a sleeper you must log your break on line 2 not line 1. It does not say you have to go from line 2 to line 1 to take a potty break.

    So that is the the take on the law you posted from a DOT office and it doesn't match yours all of a sudden you parade of laws is deflected to something else. Was a nice try though
