For clarity, my husband does not lease or own a truck. He gets paid by the mile; has no expenses related to the truck or loads. You mentioned a driver should earn more...given the situation I am describing, how much do you feel would be acceptable per mile? He does not get a % of load.

You cant base what you want to earn from looking ar someone elses salary. Do not concern yourself with the next guy.
If your bills are covered and your husband is content then he's making a fair wage. If not or you guys need more, then make adjustments on his next job search.

I probably would never do 1099 you pay more taxes, and lack retirement shelters other than a roth IRA.

I'm no expert... But they say its illegal.
Risk goes to employer. If driver gets a wild hair, they could theoretically claim they were not a contractor and you (employer) owe taxes.
Personally,.. I say make sure a contract is written out. Signed.. All parties agree.. Blah blah blah.
I wouldnt hesitate to go on 1099 again given the right circumstances and motivation.
