    As in off duty. I mean, hypothetically, your at the motel on Saturday. You don't have deliverey until Monday. Can law enforcement get you. Have you weigh your truck. Inspect it. And then let you go back? In other words. If I'm off duty under personal conveyance. Can they stop me and put me "on duty driving" status for they're own benifit?

    I guess hypothetically they could do that. Realistically, the odds are like 1 in a billion of that happening. I mean, if you have a room at the hotel and see a gang of law enforcement and swat with their guns out surrounding your truck, I would just grab another ice cold beer and stay in my room.

    This happened in Missouri. And under normal off duty. I wouldn't be driving.

    If a class 8 truck is not for hire. Isn't doing business as a commercial vehicle. They are exempt from CMV rules. Isn't that what the fmcsa is saying when you are under "personal conveyance"?

    Still subject to entering weigh stations and being inspected. I personal conveyed from Lancaster TX to Stockton CA and was pulled into Chowchilla CA weigh station for Level 1 inspection.

    Not really.. That being said, if it's a situation like scottie says, where the truck is parked illegally they can give you the option to move, and break your rest, or get towed and pay the bill.
    Of course being an leo, they have the guns and tasers so they can make you do anything. Doesn't give them the "right" to do it though.
    If the truck is legally parked, go tell the office to come back when your break is over (and accidentally give him a time 2 hours after you can leave, so you can be gone when he gets back)

    The problem is, the fmcsa doesn't say really anything about pc. They say you have to be unladen, and give two examples in the guidance of usage. That's all.
    Which is why they need to clarify. In a nutshell though you can use the CMV for personal business, but it still is a CMV.

    Were you driving a commercial truck over 18k lbs? The only possible answer is yes you were.
    It doesn't say all commercial trucks, unless on pc. It says all commercial trucks. You are driving a commercial truck. Personal use I will grant you, but the truck is still a commercial truck.
