    True, but in this case, it's strictly hearsay. By what is shown in these two photos, unless the OP is omitting other pictures of damage to his truck, it is his word against the Werner driver. If the officer can't view the video, he will be smart not to issue any citation against the OP because he is essentially swearing out an affidavit and charging someone with a crime that might not exist, and he can't necessarily claim good faith in his duty. Swearing the affidavit falsely is actually a crime itself.
    The officer's job is to take statements from both sides,take pictures, interview witnesses and submit the report.Then the insurance companies decide. I speak from years experience working multi vehicle, single vehicle, fatalities and all types of wrecks in between.

    I had a friend get sideswiped in Memphis recently and it disabled his truck. Idiot Memphis cop wrote him a citation for failure to maintain lane, and it was summarily dismissed by the judge when he went to court. He said the judge raked the cop over the coals for writing the citation.

    Question, how fast did you pass him? Going by at 5 or 10 mph will probably not ripe a headlight of even leave that mark on his truck. Was this on a curve road? Strange?

    I'd demand the video, and they must provide it as the only evidence. If they say no, you need a lawyer to subpoena it.
    No way I would pay the ticket without seeing the video first.

    Lol it was a speed trap area near my house. So I go exact speed limit. Otherwise he would have got dust.

    That is all the evidence I have. Nothing omitted. If there is a video comes back and shows I did I will definitely let you guys know. I know that I'm not perfect.

    Keep us posted, I wish you luck. I don't have much else to say that the other's haven't, but being an O/O, aren't you a member of one of those OOIDA attorney/group things? That'd be a good idea.
