DO NOT GET HURT whIle working for this company! My doctor has me off work due to a shoulder injury/surgery that happened while at work, however, Quality has ordered me to drive against my Dr's orders. As we all know, if I did that and was involved in an accident, my fault or not, I could be held criminally responsible as well as both of us being help civilly responsible. They won't pay my temp benefits, even though I have the Dr's release. It's profit over their drivers and will do anything for profit, including putting the driver in this type position. It's been 6 weeks since I've gotten a check for workers comp due to this dispute and have had to file complaints with TX Dept Ins. and NTCSA. We all know how slow these clocks spin trying to get relief, so until then they left me out to dry. It looks like I'm going to have to bring action against the company we were working for in order to get something done. STAY AWAY!!!!!

1) tell the company you are hurt
2) go to a clinic or hospital, but my God, stay away from ANY Concentra! (then ask or DEMAND) x-rays!
3) contact a worker's compensation attorney right away after you leave the clinic (maybe even before you go to the clinic, but this is a timing issue, if you get hurt at 1 AM, most attorneys only have an answering service, BUT this starts that all important paper trail!)
4) jot down ALL the facts as they happened in order of the injury.
you want to have a paper trail so NO ONE can really dispute much about YOU or your injury.
best of luck to you, and by the way, in "some instances" a company MAY FIRE you after you file a comp claim, as you are now "damaged goods" and are a future risk.
i actually had this happen to me many years ago.
one more thing, as pictures are ALWAYS important at an accident, so are pictures of what caused the injury, including the place, the object, etc,etc. this will give your attorney more facts to work with.JimmyWells Thanks this. -
It was going pretty smooth for a while, but when my doctor ordered a function capacity exam they went ape **** and ordered me back to work against the doctor's orders. Considering the chemicals we haul, plus just the fact of driving a commercial vehicle, I'm not willing to put myself in a position. The Tx dept of insurance department says they can dispute it, but they will not win. They are basically holding my arm behind my back. Texas doesn't allow to sue to employer, however, you can sue the third party if it happened at thier location with their equipment. Looks like I may be going that route.

This doesn't make sense. The company's insurance wouldn't cover you, if you are out on a medical. As long as the medical paper work is updated, you should be ok. Must be more to this story.

The workers comp insurance is disputing the doctor orders due to him ordering the Function exam. I never thought of contacting the company's insurance company about this issue, but I will do that today. Great idea and thanks for mentioning it. And there is absolutely nothing else. I submitted all paperwork and Dr's orders to the NTCSA and talked to them yesterday, they have marked the complaintiff as valid and it has been assigned to an investigator in the Florida office as of yesturday.

What you're describing is par for the course of 99 percent of all companies out there. If anyone gets hurt on the job in any field it's imperative to hire a workers comp lawyer ASAP. The company and their insurance company WILL screw you.

so check with a comp lawyer in your area, he/she KNOWS the comp laws. there usually is a time limit for your to file your claim and have a lawyer. whatever that is in YOUR state, get to know it like a bible, for any and all possible comp claims.Intothesunset and JimmyWells Thank this. -
