This is common now, when you "earn" vacation it's YOURS and they can't screw with it because it's accrued and considered a wage. When a company just "gives" it to you..... they can play games with it. it's always put out as a positive thing, but it's a game. My company switched to that this year.

    Here it is ...Easy math
Work (be employed) 365 days ...Earn 7 days vacation pay .., might some companies pro-rate the vacation pay out if you only work 8 months ? Few companies will...Most won't !

In the military we earned 2 days a month. Efffectively we worked more or less than 11 months a year and were paid 12 months a year, depending...

But say your separtion date was in April, you still qualify for your vacation days even though you would not be finishing the year out (providing you still had vaca days accrued).

Estes doesnt give you a portion of your vacation as you go. You get a week after 2 years, but you can take that week after 1 year. Start Jan 1 of 2011 for example. On Jan 1 of 2012 or after you can take the vacation you WILL EARN on Jan 1, 2013 if you want to. But if you leave before Jan 1, 2013 you have to pay it back because you havent actually earned it yet. Your TM must not have explained to you how it works. Mine did.

That's a bad vacation policy. My job is 1 week after 1 year EARNED, 2 weeks after 2 years, 3 weeks after 5 years, 4 weeks after 10 years, 5 weeks after 20 years.

In August I hit my 5 year anniversary and get 3 weeks vacation (15 days). If I were to quit in September, they would pay out those 15 days of vacation on my last check. That is how 90%+ of jobs work. So, I'd say "fronting" vacation is more on the rare side of things.

Seriously though, 1 lousy week after 2 years? That's a red flag right there. It shows they don't care about their employees. I was considering Blackhorse Carriers for a bit recently until they told me that their vacation topped out at just 2 weeks. I told them no thanks.

I usually don't give a 2 week warning because I figure they wouldn't give me 2 weeks notice they were firing me ! But of course there's an exception to every rule

So you take the week off prior to your last check, give them any excuse, death in the family, sick or my personal favorite that no one can ever question is Personal Business. Once you get that last check, they cannot come back and demand 37 hours worth of pay back from you. Even if they did, get a hold of one of your local news stations for a "5 On Your Side" news story lol, that will get the company backed off real quick.

Estes likes paying lawsuits. Talk to your state labor board.
Find more people they did this to.
    Class action.
    Collect your money.
    If you've been wronged.

Actually, Estes is the best company I ever worked for, and I worked for a lot. Im an owner operator now, but were I ever to go back to a company job, frankly Estes would be my first call.

Bad vacation policy is TAKING the vacation before you earned it. Estes trusts YOU enough to let you use it before you earned it! And thats bad on THEIR part?

Yeah, not accumulating any the first year kind of sucks, but after that year, their vacation is BETTER than yours actually.

That kind of torques my wheels. That is a form of theft. And I thought I knew it all....

It's best that fronting gets stopped. You might be the one to get that started.
