TMC percentage pay question

    Do TMC company drivers on percentage pay get to take a look at a signed rate con, which shows what the load is actually brokered for and will gross to the carrier?

    If no, how does one know that TMC isn’t just lying about what the load pays and giving you a percentage of whatever number they made up?

    By law, they HAVE to if requested but I seriously doubt they do. Also, they're contracted with their customers so technically there isn't a rate con per se but a contractual rate instead so that rate will be lower than spot during peak seasons.

    They have a brokerage which, I believe by law, is a separate entity. So there would be a rate con. I know there was an oversized load out of NM for 7000 on DAT for 3 weeks before they finally put it on a company driver. Taos, NM to Miami. Required permits, special routing and pilots. I was picking up there and the driver told me it was paying 1800. Not bad for a company driver for a week hauling only one load... but he was also getting 32% he said... doesn’t take a genius to figure they pocketed some money and lied about the rate. An owner op wouldn’t haul it for 7k, because for that level of hassle it was peanuts. But if you can screw your driver out of money for pilots...

    I here you but it doesn't matter what entity it is or isn't. If one is paid on percentage or commission they have a legal right to know all the numbers. They're only getting away with it because nobody (or not enough people) have made an issue out of it.

    I hope you like it because you're going to be there quite a while if you expect me to do your home work for you. Most states have some sort of law pertaining to this matter. I looked into it with a lawyer years ago and if you're leased on, the FMSCA has some sort of law about it too. Now please, troll elsewhere.

    Usually the one making the claim would be able to cite what they are referencing. If you consider looking for citations of your claims as trolling... well, don't know what to do for you there.

    For the leasing aspect, yes. FMCSA has defined regulations as it pertains to lease operators (49 CFR 376.12), but NOT company driver.

    No, drivers never see the freight bill itself ever. And yes you are correct, drivers dont know if their really getting the correct revenue to the truck.

    Does it matter what TMC is really getting for the load from the shipper? What drivers should evaluate is how much they get in their direct deposit. If it isn't enough, then move on. I know this sounds crazy but there is more to life than just the $$$ in the pay envelope.
