Don’t over think it man. They can’t legally withhold money owed for work already completed.

You don’t have to be an attorney to know that.

    I'll agree.
But, that's a schedule for someone that's hardwired to dig like a Badger.
Most people don't want to, or refuse to, work that hard.

They'll say "you can't do that legally".

In a drop/hook dedicated turn... yes you can.
I left NC and put off 3 stops in WA , and loaded in Portland.
Made it to east of Boise and I'm finishing up a 34.
I'll start today with a fresh 70 and by tonight I'll have 4300 in a 7 day stretch (including the 34).
    ALL LOGGED LEGALLY.

You have to roll on 10.
You have to roll after 30.
You have to manage and plan.

    You can NOT be lackadaisical.

Now it's one thing if she refused because she didn't have the hours. My advice is to try and get really friendly with recap hours in that case. Please allow me to clarify. I'm a reefer driver and I mostly sit and wait at shippers forever and a day to get loaded and unloaded. Now I won't spin the whole "learn how to trip plan" jazz that some like to as I try to understand both sides. But since she's drop and hook as you say, it should be easy right? Example: One load I pulled years ago had me deadhead from Colorado all the up to Nebraska for some Tyson meat. I was required to get there, check in and have the trailer washed on site. Then I was to park my empty and grab the loaded one for weighing before getting the proper paperwork and leaving. A Tyson load gets you to take a 10 hour early and continue on a full clock which is a pretty good deal to me. But in her case, I see an issue. She clearly told them that she was out of hours. My question: Did she at least try to get them to reschedule instead of outright refusing? Did she at least try to see how far she could get and maybe repower it off and the company refused? What did her 70 hours look like? If they are withholding her money, then yes it is coercion. This is the exact reason I left the oilfield. If you didn't fudge logs and actually took your 8 hour rest break, they'd push you to the bottom of the barrel and make sure you didn't make the advertised $5,000 month. I lived this until they shut that company down. Where I am now, I communicate my hours with my dispatcher to the bottom line. If we know that this load isn't making it, I ask them if they will reschedule or repower it off? I've had to repower more loads than I've cared to, but I always made out in the end. Just wish I had more insight into her situation.

    “dig like a Badger.”

Those little vermin can bite too. And, I know a thing or two about biting?

    “You can NOT be lackadaisical.”

That’s the truth! Last time I took one of those I was dropping deuces every hour for half the day!

I liked that word. Lackadaisical. Its a good word. I see too many wearing flip flops like they are on some sort of beach vacation moving at a speed so slow as to be late fueling. =) because they are lackadaisical.

What I really liked was a poster on TTR putting up a video at highway speed where the ELD rolled over with 2 minutes left on duty status for that day prior to midnight to a fresh working day with plenty of hours gotten back by recap at midnight. Without having to stop and do paperwork in logging.

I don't mind precision in life, but sometimes it gets to be a double edges sword cutting those who try to be too precise.

More to this story, I do a lot of temp loads for UPS and UPS/Freight, A least with the people I deal with would tell you to leave when you have hours and if the load had to go they would simply send it out and you would take another. Theres got to be more here than this.

Not to mention most megas are very good about following hos. Not perfect of course, but they don't do anything obvious. They know they are one wreck away from a 100 million dollar lawsuit if they do obvious violations.
