I skipped a bunch of posts but I think you are too focused on the backing out of the driveway part. Simply tell the cops the other driver came into my lane and hit me.

This thread and its subject is beginning to remind me of a VERY old case from my teens in North Georgia. The wife of a County Commissioner was driving drunk and hit a girl I knew. The girl was just 16 and had not been driving but just a few months. When the Deputy Sheriff got there he ignored the DUI and took the wife's story as the gospel. That poor girl's family finally had to fork out some money. I sure hope this OP has not been involved in something like that. You get into he said she said situations sometimes that other person has political connections and the Cops AND the courts will not believe you. This is one reason I highly advise ALL truckers use a go pro camera in their trucks and their POVs.

i think it best that you say no ore here, get a lawyer, talk to him (or her), and ask for measurements of the road where you say she had at least 400 feet. unless you actually measured it, you cannot be certain it was 400 feet.
i'd not get any more involved talking about it here, as you never know, who is scanning these sites for information, that can be used against you.
i do wish you the very best, and maybe in the future, do not back into a street, but rather pull into the street, from someone's yard, place of business, etc?FlaSwampRat Thanks this. -

I was thinking the same thing -- other party had too much undue influence even for the cops.
Years ago I was hit while stopped at a red light. Other car drove away without stopping. Fortunately not too much damage, and I got a description of the vehicle that hit me and its license plate number. I pulled into a parking lot and called police to report it.
At first the police lady was like "that kind of damage will cost you about $1,000 to repair, but since you got all that info on the other car it will be so easy".
After they called in and (I assume) had the owner of that car/plate identified, their whole demeanor changed -- went silent and basically wished me luck with repairs. When I tried to get a copy of their report, I kept getting stonewalled. If they had told me I was mistaken and plate did not match car description I could understand. But it was more like, "there is such a matching car and plate but they say they were never here on this street today so we believe them, so run along now and stop bothering us."
Granted, it actually ended up costing less than $600 when I finally got the repair bill. But it left me with the idea that police are not always on side of law and order.magoo68 and Sunshinegirl Thank this. -
I'm going to fight the ticket. If I'm at fault that's okay and I will absolutely own my mistake. I judged how far away she was based off of mile markers and by walking from where she first gained visibility of me to where I actually was. I have a pedometer. I know it's not black and white.
