Unsafe backing? Idaho

    I skipped a bunch of posts but I think you are too focused on the backing out of the driveway part. Simply tell the cops the other driver came into my lane and hit me.

    I did I told the first officer exactly what happened as he is someone who request me on calls. The first officer had to attend another call and requested another to take his place. The second officer told me to fill a form and sit in my truck. He then went and talked to the wife and her husband. Came back gave me my citation and took my form. They would have not have even known I was in reverse if I didn't say anything. Not my smartest move backing out, but even if I would have pulled out I don't know what that would have changed. She more then likely would have hit the front of my truck

    Good advice for the future, but stale for this accident. The Cops have most likely got all their reports typed up and their photos and sketches made and all filed away. I hope the OP did not tell that cop her box was directly over the line. If so and it is part of the police report IT WILL come up later. If your vehicle is directly over the center line YOU are NOT correctly inside the lane. If this is later determined to be the cause of the wheel lockdown if she left the lane or not will lose a lot of its significance in this accident. I agree the backing part is not all that important.

    This thread and its subject is beginning to remind me of a VERY old case from my teens in North Georgia. The wife of a County Commissioner was driving drunk and hit a girl I knew. The girl was just 16 and had not been driving but just a few months. When the Deputy Sheriff got there he ignored the DUI and took the wife's story as the gospel. That poor girl's family finally had to fork out some money. I sure hope this OP has not been involved in something like that. You get into he said she said situations sometimes that other person has political connections and the Cops AND the courts will not believe you. This is one reason I highly advise ALL truckers use a go pro camera in their trucks and their POVs.

    The only other accident I have been involved in was my first month doing towing. I had gotten back from a call parked in front of my personal truck got out went to my gate heard a screeching noise and here comes a guy with my mailbox under his car. He side swiped my neighbor for sucked under my truck and shot it into my tow truck. Then the kid gets out and tried to run. His mom is some higher up they fought insurance super hard they were trying to refuse to repair anything. If I'm at fault I will own it 100% I'm a big girl and I make mistakes. I just dont feel that I am responsible. She had 400 feet to correct her vehicle and gain control. Even if she would have let off her breaks she would have been fine. The road was slushy and had light snow.

    the thing is, she is a regular driver, she is not supposed to know what to do in a panic situation, where you should know, since you drive for a living.

    i think it best that you say no ore here, get a lawyer, talk to him (or her), and ask for measurements of the road where you say she had at least 400 feet. unless you actually measured it, you cannot be certain it was 400 feet.

    i'd not get any more involved talking about it here, as you never know, who is scanning these sites for information, that can be used against you.

    i do wish you the very best, and maybe in the future, do not back into a street, but rather pull into the street, from someone's yard, place of business, etc?

    I was thinking the same thing -- other party had too much undue influence even for the cops.

    Years ago I was hit while stopped at a red light. Other car drove away without stopping. Fortunately not too much damage, and I got a description of the vehicle that hit me and its license plate number. I pulled into a parking lot and called police to report it.

    At first the police lady was like "that kind of damage will cost you about $1,000 to repair, but since you got all that info on the other car it will be so easy".

    After they called in and (I assume) had the owner of that car/plate identified, their whole demeanor changed -- went silent and basically wished me luck with repairs. When I tried to get a copy of their report, I kept getting stonewalled. If they had told me I was mistaken and plate did not match car description I could understand. But it was more like, "there is such a matching car and plate but they say they were never here on this street today so we believe them, so run along now and stop bothering us."

    Granted, it actually ended up costing less than $600 when I finally got the repair bill. But it left me with the idea that police are not always on side of law and order.

    I'm going to fight the ticket. If I'm at fault that's okay and I will absolutely own my mistake. I judged how far away she was based off of mile markers and by walking from where she first gained visibility of me to where I actually was. I have a pedometer. I know it's not black and white.
