10 HR break interrupted

    I think I'm right in what I'm saying that if your break is interupted and you are made to do work then once the work is completed you have to start your break over. My company sends us to other locations owned by the same company to pick up eggs. Once there we are usually told the eggs aren't ready. Even if we give them a time like, "My break will be over at 3pm ,so I'll back in and get loaded then" they still come out and bang on the truck to wake us up to get loaded. Just want to make sure I'm right in saying that we have to start our break over after completing the work. "We get paid by the hour, so it actually benifets us".

    Technically yes, but I’m not sure I’m understanding you correctly.

    If you’re driving 5 miles during a 10 hour break, you’re in violation.

    If you’re in a dock door, being loaded while you’re on your 10 in the sleeper - you’re all good, after 10 hours that is.

    I’d be inclined to put a note on my door - “ On my 10 hour break - sleeping - on duty at ‘x’ am/pm”

    However, there is a lot of ‘pro activity ‘ expected of us. I’d always welcome getting loaded early or on a break - but I was paid by the mile in those days.

    If it's so common you should get a sign that says "You weren't ready when I was, so now I'm not ready when you are." Or just simply "#### off, I'm sleeping."

    With my old ELD's if I moved the truck even a couple of feet I was put on duty and driving. Most of the time one can get away with moving into a dock and getting loaded then going back to park with out being taken out of sleeper. I welcome the opportunity to get loaded or unloaded while on break. Gives me more time to run.

    Technically, OP, you are correct. But practically, stay on break.

    You are in violation. 10 hour sleeper is 10 hour sleeper. HOWEVER, you just cannot drive until you have had 10 hours in sleeper.

    IF that does not egg them on to improvements or ruffle feathers I don't know what will.
