There is a guy I know whom I see a good bit at the VA medical center in Hampton Va. This guy is a Virginia CVSA/MCSAP/DOT officer. He comes 3 times a week for a treatment in the same area I go to. I asked him close to a month ago about this potty break issue as it relates to line 2. I was surprised by his answer. He told me that some of the officers he works with are trained to try to confuse truckers in regard to part 395 and try to find ways for catch them contradicting themselves. He told me clearly and I am going to say this also applies to all of you that still actively drive. Give the officer your log, or give them access to the e logs and CLOSE YOUR PIEHOLE! YOU are NOT required to answer any questions. Every piece of information you are required by rule and law to provide is in paper form or on that elog. One of the most frustrating things I have seen is the after when someone EVEN in a personal vehicle once stopped develops diarrhea of the mouth. You don't have to be a dick when you do it either. Just hand the officer your paperwork and go stand silently nearby and smile when asked these kinds of questions and tell the officer RESPECTFULLY they have all the info you are legally required to provide. You do have the right to remain silent in these situations and honestly you really should.

If I could thank your post more than once I would. The only thing I am surprised about is that you were surprised by Officer Friendly's response. Despite what we are taught as kids, LEOs are not our friend. They have a job to do and they get a whole lot more practice at it than the rest of us. I have frustrated more than one officer though, by doing exactly what you posted... every question they asked I simply referred them, and re-referred them, to my documents they were holding.

 

If there monitering log , they should already know your close to reset time, if not tell them , then they can start planning to use you

 

Staying quiet is the ONLY policy. This does not mean being snarky with the officer. It does not mean you have to be nasty and belligerent either. Just respectfully inform the officer you have nothing further to add.

 

The reason I say be careful-- the big June Safety Blitz this year will be focused on Hours of Service. Officers are being trained right now to look for stuff like lazy logging ie. 10 solid hours in the sleeper or 10 solid hours off duty will raise a flag and they will ask about it, fishing for a falsification violation for example.
