I think if you look closely at all the bigger mail carriers, they all have been cooking the books to my understanding.

I worked for a 110 truck operation out of Harrisburg Pa, the IRS illegally seized or accounts and the post office yanked our contracts. Postal fleet services out of Florida was brought in by the us postal service and given everything on emergency contract until a rebid could take place, all drivers were sent to postal fleet services to apply with guaranteed jobs (temporary). If beam went bankrupt my guess is MCA, MTI, and Eagle Expresslines would take about half of it. Other smaller area contractors would get other parts of it.

Ok, if the IRS did that, which they have done before so let's not fight on that
Did the carrier ever get it resolved,and did they get their contracts back
Or did the court battles and legal fees do them in

Court date is May 31st. We might find something out then But I would almost bet you that somebody is going to prison or there is going to be a fine so large that it will break the Beam Bros. Which I am hoping. Knowing them, I hate to say this but in my opinion they are deserving for whatever comes out of all this. They requested a jury trial, probably hoping since they are "pillars" of the community, sunday school teacher, deacon that they can convince the jury to find them innocent.

I was asking the other poster who said the IRS took all their finds on a whim.
Then they tru and build a case afterthe fact -
95% of the trucks and all trailers were leased, when the funds were seized and the US postal service brought a company in to take over. The carrier was then forced to file chapter 7 bankruptcy (could not pay bills with zero funds). All leased vehicles were surrendered to the leasing companies. There was $731,000.00 seized by the IRS, $245,000 of it was for our wages for the final 2 weeks that are now tied up in the bankruptcy court, in other words nobody got paid.
The bankruptcy trustee is now working on getting a court order to reverse the $731,000.00 illegal seizure so it can be distributed according to the bankruptcy code. (wage claims have priority in the distribution process so i am confident we will get paid someday)
I signed up for the PACER system where you can look up the bankruptcy court proceedings at a cost of .10 a page, being that i have an almost $4,000 claim in for unpaid wages i feel .10 per page is a small investment to keep up on the status of my claim.
I assumed that someday the contracts would have to be returned or a massive civil suit could take place between the former owner and the federal government. I dont know all the legal terms but the bankruptcy trustee stated himself in court proceedings it was in illegal seizure of funds.

I would just like to add that although i was not paid the nearly $4,000 in wages i worked for, I do not in anyway place the blame on the owners of the company, they were good people that gave me free training with no contract to earn my CDL. I would still be driving for them had this not all happened.

Now I posted all this to paint this picture. The Shenandoah Valley is a Republican "hot bed" and by retaining Mr. Obenshain as their defense lawyer, plus the fact it is going before a jury, the Beam Bros. are without a doubt playing the odds in their favor when it comes for the verdict. A friend who works there told me the government tried to settle the log violations and even the improper use of government credit cards, but management refused any settlement.
They have a recording of a manger yelling at a driver to fake his logs or get fired, that's not going to look too good given the era we are in.Toomanybikes, passingthru69 and crazeydude Thank this.
