Hide the truck next time you park somewhere. You were caught by a fisherman law.

When you recognize that the Law can do whatever they please to you regardless of the initial peaceful "Designed happanstance encounter..." They will find something.

Depends on how long you were there for. If CHP is working a Brake Check area, they usually have a chopper in the air directing the enforcement folks and know how long you were there for.

Absolutely fight it. You’ll need your ELD logs to prove you were there for a few minutes. Make sure you logged the time with the officer.

Smoked mine once long ago at Monteagle, TN. Their fault, had no brake check area place or sign.
Further enhanced by a 5 speed OD trans. Did drop a gear as sign said, down to direct. Rapid ride,
got it stopped before the river bridge pull off at the bottom and wound them back up tight.
Was on the old two lane in 1957. Tehachapi in 59-60 was like a backyard slide.

That won’t save you. Your company is going to say, “Did you do a trip plan? Did you look up the mountain grades?” By the way, were you using your jakes? I use my brakes very little when going down a mountain grade. It’s about being in the right gear at the right point and turning on the jakes. If you have to use your brakes excessively in a downgrade, you were in the wrong gear.

Yessir, guilty as charged. Lots of good assists were not available in 57. Rand maps did not show grade %,
Mr. Jacobs had not produced his exhaust brake at that time, and trip planning was mostly being told to go to, get a load of, and take it to. "Check call" in when you are done there. Much progress has evolved in the
    trucking industry.
