I was trying to frame my question so I get a specific answer, but I guess I failed. Anyways, the example I used was to show that many owner operators are still trying to pay their drivers 1099 while force dispatch their drivers around.

I went googling for that ruling to read it for myself, couldn't find it. Maybe @Dave_in_AZ can post a link?
Anyway, maybe I need to clarify just what I agree with. The part where a driver is put in a truck that they do not own, dispatched, told what to do and how to do it, etc. just like an employee, should not IMO be stuck under IC 1099 classification.
Drivers have been getting ripped off for far too long. And from what I've read, roughly 80% of cases challenged end up ruled in the driver's favor. So it's definitely a problem that needs fixed.TheyCallMeDave and Tolmie Thank this. -
Landstar don’t hire drivers, it’s the fleet owners. So technically, Landstar is good but fleet owners, I am not so sure.
