    Arrived at the customer at 1100 for a 1700 appt, they say come back tomorrow at 1700, you have done been rescheduled. So I am technically still loaded, but parked off duty at a motel, thirsting for an ice cold beer.

    The rule states no alcohol IN THE VEHICLE....motel(?), bottoms up dude! Remember 8 hours before scheduled shift no consumption.....oh yeah...have a couple greasy burgers to help absorb the alcohol.

    And it's four hours, not eight...

    §382.207 Pre-duty use.

    No driver shall perform safety-sensitive functions within four hours after using alcohol. No employer having actual knowledge that a driver has used alcohol within four hours shall permit a driver to perform or continue to perform safety-sensitive functions.

    It is eight hours post-accident (or until tested)...

    §382.209 Use following an accident.

    No driver required to take a post-accident alcohol test under §382.303 shall use alcohol for eight hours following the accident, or until he/she undergoes a post-accident alcohol test, whichever occurs first.

    You only have to wait 4 hours if you stop drinking.

    Just pound em back your whole break, no sleep or sobriety, it's called taking a wet 10 guys...
