    without an attorney, he can be made to wait the full 3 years, for any payment, when an attorney can cut that down considerably.

    why wait for that money..??

    he could have had that accident in a state where he only has (say) 10 days to file a claim. not too many people know the proper legal procedures to file, let alone know how much time they have.

    That says the claim needs to be filed within 2 years for personal injury and 3 years for property damage. Not that an ins co is allowed to mske him wait years before they settle.

    no, that is the time line to file..once a claim is filed, who knows when it'll settle.

    it can be 5, 10, 20 years...

    there's no time limit in settling a claim

    and they (the insurance company) has more money than him, to delay, time and time again, where he will just give up.

    I think this post might be dead. But Ive gathered a lot of intel and I appreciate all your opinions and views. I think Ive gotten a good bullet point to continue for tomorrow.
    Call financing company and talk to them and see if they possibly had insurance on the car and then mention the gap insurance I purchased at time of purchase.
    Email the officer. Get a copy of the police report and call many accident attorneys. See if any will take a case where there is enough $ in it for them and if no hits look on the police report for their insurance provider. Contact them and see if in a small claims court will cover price of car or anything else. Prepare for license to be taken away for a year to four and thank god I alive.     Reinstate the coverage. And have it autodrafted out of your account set aside for this purpose.

    This is where you need to lawyer up. At the moment of the accident you were a uninsured driver. There is no way to rewind time.

    You were driving without insurance, so you're pretty well ####ed, but a lawyer and a generous amount of agreeing with the Judge when they throw the book at you might let you keep your license.

    If you got gap insurance, you might be golden! I would call immediately to find out what it covered!

    Well I thought car insurance was expensive in BC until I read this....now it seems like a bargain.

    i have "GAP" insurance through MY insurance company, i was told by my agent that most times, when you finance, the dealership offers it, but usually higher than what an insurance company will charge you.

    if you denied that GAP at the time you bought the car, you would be screwed, they cannot "just add it on", without your say so/signature.

    you could check the bill of sale, everything is itemized on that all important invoice.

    yes, like in the old saying here about real estate...location...location...location....

    in major cities, it is said that the propensity of accidents (more cars in the area) and more thefts, break-ins (do to population) takes place over say a farming community, or suburban area.
