Used for the kids?The rational’ is that proportional living expenses are an expense of the kids. Their portion of the rent (House note) electricity, water, gas, cable, food, transportation, etc are all legitimate uses, not just buying or paying direct expenses.

It may depend on state, as in my state (Mississippi) it’s a percentage of “adjusted” gross income (Which is usually less than net). 14% for one child up to 26% for five or more.

That money is hers to spend as she sees fit . I know that sucks to hear but that's what any lawyer and Judge will tell you . I know my ex and I went to a mediation with lawyers present and worked it out , both financial and custody. That went before a Judge , he approved and life goes on . I ended up with custody a couple years later and told both her and the Judge I didn't want any money unless a medical expense came up . Best thing to do is show up on your days of custody and take care of business , you can anyways ask for more days . If she doesn't comply with custody agreement take her back to court . I have been on both sides of the fence and it sucks, good luck .

In my personal experience it has always been based on gross taxable income. Per Diem lowers that income and it was not included.
Maybe it varies by state, I don't know. I only have experience with CA and CO.Last edited: Nov 18, 2019
