Company drivers are not legally responsibility for anything, follow the money. Where the profit goes so goes the responsibility. Generally employee's are only held responsible if extreme negelance can be proven. As far as the equipment goes, the driver is not responsible if he is off duty. Look at what off duty means, "relieved of all responsibility", period. If a company tried to get me to pay for anything to do with there equipment or load I would be glad to give them my lawyer's phone number.

Sure you would dear..... "Your lawyer"... LOL I'm sure that you bring all employment contracts to "your lawyer" to give you permission to sign the contract? Their lawyers would simply trot out the forms that the driver signed agreeing to the terms of employment. If you agree to something, its legally binding.. it has nothing to do with hours of service regulations. What a friggen joke!

NOT MY PROBLEM ...something happens to your truck......NOT MY PROBLEM.....If you hold me responsible of anything ... I will call my lawyer & my mommy ... All the company is asking is for you, the employee, to do is to take care of their equipment when your on home time. I don't think it's unreasonable to expect that. If you think your only responsibility is to set the brakes, take the keys out of the ignition and walk away, then have your lawyer call their lawyer and they can stand around and kick each other in the fiduciary 'nads.

Precisely why I'll never work for anyone that is located more than 30 minutes from home. Leave it at their yard.

Would you want someone parking your equipment where it could be damaged or broken into? I know a guy that parked at a truck stop and when he came in to do his PTI his front end was smashed cause someone backed into him and left. I was required to find secure parking for my truck and trailer and I did. That's a totally reasonable rule for a company to have.

peterd, p608, Catmando and 1 other person Thank this.
