Companies or small carriers that hire SAP drivers

    I just finished my last follow test last week I’m no longer there but they’re still accepting sap drivers

    You say accept sap driver. But they probably turn down sap drivers every day. You probably have a good work history or know the owner.

    Wasn't sure about throwing my hat into this thread but I unfortunately have some insighta that may help someone.

    I worked for a company for 12 years and got tagged with a random drug and alcohol screen. Tested positive for alcohol with a BAC over .04 but less than .05. This all happened May of 2023. I was suspended for two weeks until I consulted a SAP ($600 fee) along with a clean RTD breathalyzer test.

    Two weeks later I was back like nothing happened. I was out the $600 along with the two weeks of lost pay. This all came out to be a $3,000 incident. As much as that sucked, I really didn't care too much about it because I DID get my job back and I intended on retiring from there anyway. On top of that, they knew about the follow up testing and I was paid hourly to drive across town to take them.

    Then July 31 happened and my company went bankrupt. I managed to do my RTD and one random test when I lost my job permanently.

    As usual, I have way more luck than common sense and ended up with another local job that not only pays me roughly the same, but they also agreed to take on my year of random testing and pay me hourly to go to drive across town to complete them. This process should be done four more tests from now which should be around June as my one year mark.

    Not sure how everyone else is doing on this, but I have to complete up to six randoms over a one year period AFTER I completed the initial RTD process. Then after I am all done (and this is how I understood it), you move on to Step 6 and your issue turns into a "resolved" violation. I whole heartedly think this is more than fair up to this point. You screw up, you own it, and then you deal with working on resolving your case.

    Here is where it gets wonky. Once your violation is resolved it will stay on your Clearinghouse records for 5 additional years for any prospective employer to see. This will usually put your job application to the very bottom of any list, assuming it doesn't get tossed out first. Personally I shouldn't care since I got a new job, but there are enough people that did everything right after they screwed up. It seems completely unfair to deny them something as basic as employment for five additional years after proving they are in compliance.

    I want to thank @Chinatown for his continued efforts to point people towards finding work again. I do want to tag @brian991219 because he had quite a bit of insight on this as well.

    My question is, on the day I got hit, I was not even scheduled to drive. My company knew about my random for several days in advance and forgot to serve me the papers until the last minute. To make things worse, the machine they used crapped out in the middle of testing and they had to take it apart. I requested that they give me a new test with a new machine since they tampered with it. They denied me this request because they didn't have a backup.

    Is there any recourse to fight this? I doubt you could convict someone of a DUI under the same circumstances.

    @road_runner Alcohol tests, even random, can only be administered while on-duty, immediately prior to coming on duty while ready for duty and immediately after the end of tour shift prior to being released from duty. Random drug tests can be administered while off duty, however it is poor form of the company to notify an employee while off duty to report for either random test.

    Unfortunately, the system is stacked against drivers and drug and alcohol testing is very difficult to challenge, even having some regulatory prohibitions against challenging and making the MRO findings more or less the gospel truth. It is above my skill and knowledge set if there is a valid legal challenge available in your situation, however at first glance that random alcohol never should have been administered, and if the machine failed as you say it did, the test should have been cancelled and another lucky driver selected as a replacment candidate.
