If I'm not mistaken, negative info can remain on DAC for 7 years. DAC is subject to the time limits set in the FCRA--same as credit reporting agencies.
audeygdad Thanks this. -
"DAC is subject to the time limits set in the FCRA--same as credit reporting agencies."
And, after 7 years, the credit agencies can put it up for another 7 years if they choose.audeygdad Thanks this. -
If they do, they are violating the FCRA and can be lit up.justa_driver and audeygdad Thank this.

Not saying it doesn't happen though.

I had a starting/backing violation 4/07 and just got my dac report 2 days ago, and it's still on there. Is that normal?

You should be able to get that OFF your record after 7 years (Assuming it was legit in the first place).
Hireright (which used to be DAC) is in MY opinion, a shady, semi-legal operation in the first place. Because they take company reports as gospel, with very little if any counters from the employee.
Your credit report is based on when and whether you paid on time. That's a pretty concrete thing. You did, or you didn't.
Hireright, on the other hand is based on the OPINION of the reporting company. A Wholly subjective thing.
Hireright LOSES #### near every lawsuit against it for this exact reason. They stay in business based on the fact that most truck drivers don't have $15k to plop down on a lawsuit.Badmon, audeygdad and chrism1367 Thank this. -
I think there is a class action lawsuit against them now.

However let me ground this conversation back to reality. DAC is a database as most of you know. DAC going out of business will not remove negative information about you, even if said info is wrong. Don't forget that 10 year driving history you are required to give upon applying for a driving job. If the carriers that now use DAC can't because of this lawsuit what some of them are going to do is stick a disclosure form in your face so they can find out about your driving history and why you no longer are with said company. Don't sign the form and you are not going to get that job. -
I pulled my dac and it only goes back 10 years. Nothing on it. Now if it went back 30 years or more... he he he.
audeygdad and Dye Guardian Thank this. -
Anywhere you've worked in the past 10 years is required to be included on any job applications you may fill out, and your prospective employer is required to try to contact them to verify your employment history. Since any of these companies, so long as they are telling the truth, can divulge your history (incidents, etc.) when they verify your employment, I don't see where it matters whether or not DAC keeps it for 5, 7, or 10 years. Not everybody reports to DAC, so it is an incomplete history at best.
Simple solution: Don't crash into things and be where you're supposed to be when you're supposed to be there. Do that, and there won't be anything negative for anyone to report.48stater Thanks this.
