On duty = Not motor carrier compensated activities. You do not get paid to exercise.

This is one of those 'scenarios' where the FCMSA wants you to report compensated time in addition to your Motor Carrier compensated time, their idea and methodology is not enforceable.

An Owner Operator is not compensated by a motor carrier when repairing his own vehicle while off duty.

Volunteer 'work' is not required to be reported [after all it is not compensated] yet mowing the grass for the widow next door and she slips you $5.00 is 'supposed' to be recorded as HOS. Think about that, you could volunteer to drive the sunday school bus for hours and not record the time against your HOS even though you probably will report for work in a few hours.

This is one of the most impossible regulations to enforce and ambulance chasing lawyers might find out; especially if the 'side gig' is advertised or announced on social media, only if they spend the coin to research your off duty time.

OP, it looks like your HOS wouldn't be affected compared to an OTR driver.

    Oxbow Thanks this.

Right. Remember the Walmart driver that rear ended Tracy Morgan?
Drove all day in his POV to get to his truck.
Legally, he was fine to drive.

Driving has to be done within that 14 hr window ..you can be on duty Not driving however many hrs you want, but that takes time from your 70 clock and will require you to have 10 hr break off and/or sleeper to get your 14/ 11 hrs back. The 14 hr clock there for you to complete all driving within that 14 hr window. Only exception is if your doing a split SB n that's another discussion as it only kicks the 14 hr clock down the road

A guy I used to work with and I got into this subject a while back. One of those types of people that argue just to argue. I finally said, log it the way you want, and I will log mine the way I want. In 40 years I have never had a log violation...
