Swap drivers in the trucks for a day or two compare the fuel mileage, that will tell the tale. FWIW I am approached pretty often from company drivers wanting to sell me fuel. Its something that rubs me really harsh.

Every once in a while sitting in truck stops you will hear some 'owner op' offering to meet you at the fuel island to pump 100 gallons for you up to $1 dollar off the truck stop price. They will claim there is no tax evasion, that they just need some fast cash to get home or some other sob story.

You're his boss carguy and hes been driving for you for 3 weeks and you now come to surface with this?What makes you so sure hes doing this?I would have confronted him the first time.If you have solid proof,keep his last check fire him,put this on his DAC and sue him for the rest owed.

Pretty hard to prosecute for theft without a witness/video. Contact a few of the fuel stops to see if they still have video of the times he fueled.

You must have solid proof of your claim, it could be that someone stole fuel from him while he slept at a truck stop, happens more than you know, there are guys with pumps and long hoses that can take fuel out of your tank quickly. And as mentioned before, make sure the truck doesn't have a problem. Just be sure of what you accuse someone of unless you have solid proof, I am not saying that he didn't do it, just that you need solid proof, once you get that then prosecute.

It could be many many things, but over a three week period, having fuel stolen from your truck more than once or even twice is highly unlikely....

It has got to pass the "reasonable doubt" test to prosecute. What if he loaded on the west coast with one or two other guys at the same place, and they are all running together to the east coast to deliver at the same place, and one of the other drivers is the thief? There are reasons that you must keep calm and think things through before accusing someone of a crime, and one of them is to know the facts, we in this thread only have a small snippit of the facts, with few details.

I think you may have to do some homework, do you think a driver that just got hired would start out stealing fuel before he even found out if he could make money at your company. I like what Gman said about checking the computer - send him out in a truck thats known to get great mileage for a weeks trip- while sending an honest driver out in "his" truck to make sure there is nothing wrong with it and to check the MPG's.
If he had this same truck from the beginning it may be running crappy -and that driver just thinks that is how it runs.

Yep, they are awful quick to build the gallows. Looks bad I'll agree and that's a big number to say it went out the stacks with a lead foot but it's possible. 3.2 is all my V8 Cat got for mpg. Just cause "Johnny" got 7 doesn't mean I will. Just sayin.......
I'd think this through clearly before I acted. Traps can be set like daily limits and you can get him to hang himself.

Carguy, I just don't think you posted enough info here.
Is this driver a newbie or a 10 year trucker ? How many trucks do you have? I can see stealing fuel from your employer as more of a scenario where the driver has been there a while -treated like crap - makes no monies and gets desperate or just criminal to get even selling your fuel to pay his rent.
I am not saying that happened -- i just think there are easy ways to check --you may end up firing a guy that went to the trouble to put in an application and go through your hiring process and wants to work - when all that is wrong is a brake is hanging up slightly here and there and you are sending him out with 80,000 every time and uphill both ways.
