My X has struck again & possibly ruined my chances of becoming a truck driver. I've been living in my car for 7 months because of him & have been taking the necessary steps to start driving school. I wasn't "driving" last Saturday but was in the driver's seat (for the night) of my car, about to have dinner w/ my dog & chill for the night; HE found & called the cops on me (because he couldn't do anything physical against me since we were in a public place). I got a DUI & my car/home is in impound. Hes taken everything including my next step. Is there any way I can still go to school and drive?My record is clean until this.

Depends on the state, as far as where the keys are, in New Mexico, if they can find the keys at all, you can be charged.
I doubt she has a whole lot of money to fight this, if she has been living ina car for 7 months, I can't imagine how bad things would have to get for a gal to have to live in a car for 7 months.
Living in a car but has enough money to support a dog, and drink, seems like you have some goofy priorities.
Me thinks Paul Harvey needs to come from the grave and let us know the rest of the story. -

That’s going to depend on how long your hearings go on and if it’s going to be a wet reckless or a DUI
But while In the process of your dui you can’t get a commercial license or any for that matter. and no matter what unless the case drops you’re going to have it suspended for 1 full year. Plus Drug/ alcohol classes fines etc etc.
What I’m saying is it’s going to be a tough year. But, once it’s over you’ll get another chance at driving but not a truck unless you get a license somewhere where they don’t share the same system with the rest of the country.. I think George/ Tennessee or some thing.
And even then insurance wants over 2 years experience having a general license -
I can’t honestly say what California says about being in control of a vehicle as far as a DUI charge goes. In Mississippi she could have been charged if she was behind the wheel with the keys in her possession, but it’s a stretch.
Can you prove you weren’t driving? Was the motor cold? Any video of the area that would show that you weren’t travelling? You need a copy of the report to see exactly what the officer wrote as to why he came to the scene, etc.jamespmack, TripleSix, exhausted379 and 2 others Thank this. -
Pretty simple -
Show up in court with documentation that you’re homeless, living in car, and applying for CDL school to better your situation.
Explain you’d settled in for the night when shenanigans occurred. No driving intended, and reference the ex’s attempts to ‘F’ your ‘S’ up at any given opportunity.
