All that lawyer has to prove is you didn't use SMITH system and that will be easy to prove especially with supplied dash cam footage you will show up to court with. You didn't drive defensively and not sure if your lawyer will help you much.

Couldn’t find an eastbound shot, but at the 9 minute mark, they run by the pickle park in Malvern. If it was at Malvern, it would make sense...the rest area is in the median, lots of trees, eastbound is curved left and elevation changes. And the on ramp is to the left. That would explain the visibility, the car stopping in the left lane, and OP’s difficulty stopping.

I’m familiar with it. If it was raining or the road was wet, it’s one of those sections of roads that you get blinding spray off vehicles. That could of helped contribute to problem.

There is a real sharp curve somewhere between Hope and Texarkana, seems like it’s a lot sharper on the westbound side.
I always hated getting passed in that curve because they always came over into my lane.
But it is pretty flat there and on a nice sunny day you can see a long ways off -
That's Texas law, when I had my accident in 2001, no way I could avoid rearending the other vehicle. Cop wrote me up for it, had to hire a lawyer, court dismissed it 5 months later as unavoidable.

I'm familiar with it and even in good weather it can be a dangerous place. With the road curving and the short get on ramp from the rest area, it can be a very bad place to pass. With poor visibility, going through there at or near the speed limit is crazy. Trucks cannot get up to speed before they run out of ramp and we all know the way some four wheelers like to stop at the end of the get on area.

Lot's of times we get accused to being armchair quarterbacks. I must have missed the part in the opening post with the gigantic single sentence. If it were at the Malvern picklepark, then it makes sense because YES, it can be quite treacherous, because it is a sudden, quick left hand downhill curve. And that's on dry ground.
Regardless, OP is still in hot water and needs to lawyer up for damage control.G13Tomcat Thanks this. -
