Are we completely sure that the OP wasn’t stopped and the car didn’t back in to them at a high rate of speed?

All that lawyer has to prove is you didn't use SMITH system and that will be easy to prove especially with supplied dash cam footage you will show up to court with. You didn't drive defensively and not sure if your lawyer will help you much.

Couldn’t find an eastbound shot, but at the 9 minute mark, they run by the pickle park in Malvern. If it was at Malvern, it would make sense...the rest area is in the median, lots of trees, eastbound is curved left and elevation changes. And the on ramp is to the left. That would explain the visibility, the car stopping in the left lane, and OP’s difficulty stopping.
@wore out, are you familiar with the area? -
I’m familiar with it. If it was raining or the road was wet, it’s one of those sections of roads that you get blinding spray off vehicles. That could of helped contribute to problem.

I always hated getting passed in that curve because they always came over into my lane.
But it is pretty flat there and on a nice sunny day you can see a long ways off -

Contrary to what the article says,it was a horse that died, not a person. It actually made it into an issue of Motor Trend. Even those Amish like to hammer down too much!Last edited: Mar 10, 2019
