HOS ag exempt question

    If I'm hauling cattle a long ways from home. Roll through a scale unloaded and get inspected. I'm 50 miles from my next load. Do I have to give my logbook to the inspector when asked?

    Yes, unless you are an employee of the farm, driving farm equipment, within 150 miles of the farm.

    Seriously? Yes you have to show it when asked. Running ag exemption doesn't matter about that.

    You would need to show your logbook, but you could be logging off duty or if you have an ELD you could be logged out or logged in and logging line 5 personal drive time. Either way if you are within 150 air miles of a cattle pick up/drop off the HOS don't apply, but you still need to show your logbook if inspected.

    Drivers Operating Unladen Vehicles Traveling Either to Pick Up an Agricultural Commodity, as Defined in § 395.2, or Returning from a Delivery Point

    Question: Does the agricultural commodity exemption (§ 395.1(k)(1)) apply to drivers while driving unloaded within 150 air-miles of the place where an agricultural commodity will be loaded, and to that portion of an unloaded return trip which occurs within a 150 air-mile radius of the place where the agricultural commodity was loaded?

    Guidance: Yes, provided that the trip does not involve transporting any non-agricultural cargo and the sole purpose of the trip is to make a pick-up or delivery of agricultural commodities, as defined in § 395.2. In that case, driving and on-duty time are not limited, nor do other requirements of 49 CFR part 395 apply.

    When I pulled pneumatic we had an officer from the Iowa Highway Patrol speak at our annual safety banquet. He said if you’re ag exempt at that moment you don’t have to show anything, you’re not required to have a log book when exempt.

    Petsonally, I was inspected at the scale in Belleville KS hauling feed during COVID. I didn’t take my tablet inside and she even made the comment of since I was exempt she can’t look at my log.

    Yep. It’ll show AG exempt. If correct. Where you’re loading;’(source of commodities) and elog they can have you send it to them. They can and will check the radius of air miles.
