    I disagree with the ''must'' part. Yes if the carrier wants to use the 70 in 8 days it applies but not mandatory.

    Also in this particular case it doesn't matter because he won't be going over either.

    Question 1: May a motor carrier switch from a 60-hour/7-day limit to a 70-hour/8-day limit or vice versa?

    Guidance:

    Yes. The only restriction regarding the use of the 70-hour/8-day rule is that the motor carrier must have Commercial Motor Vehicle CMVs operating every day of the week. The 70-hour/8-day rule is a permissive provision in that a motor carrier with vehicles operating every day of the week is not required to use the 70-hour/8-day rules for calculating its drivers’ hours of service. The motor carrier may, however, assign some or all of its drivers to operate under the 70-hour/8-day rule if it so chooses. The assignment of individual drivers to the 60-hour/7-day or the 70-hour/8-day time rule is left to the discretion of the motor carrier.

    I wondered about that. Since I’d Operate on 60/7 as a Local Driver. Yet they also had Linehaul Drivers running 7 days. I wonder if since the OP is working 7 days total, if it would be technically required.

    So it sounds like the operation that is less than 7 days a week MUST use 60/7.

    I don’t think they have to. It works good for Local Time card work. Staying at 60 hrs max per week, No log is required. Time card is the Log. Too bad the OP doesn’t work 35 hrs in 4 days. Having Friday off, (34+ hrs) he could work 28 hrs every weekend. Not have to keep track of anything.

    I don't think it matters what cycle you use you just have to declare it to do a log audit at the scale or office.
    Way back when the dot have asked me that question. What cycle are you using?
    Where in the rules does it say a log'' book ''must be used? Yes you have to log your hours but a book is not the only way, I may be wrong on that .

    I also believe the 60 in 7 makes sense , after all there is 7 days in a week, and 70 in 8 used as an an option when you are a day behind to deliver a load.
    I think that was the original idea.
    Now with a reset tho you can work 70hrs in 5/6 days.

    He in theory could work a 14 hr day M, T, W, or T and reset on fri,

    If I drive 11 hours a day starting on Monday and ending on Saturday do I need to take 34 hours off duty ? No on duty not driving time
    just driving for 11 hours a day.
