There is actually guidance about this that state it should be driving. I don't agree for various reasons, mostly to do with if I'm stopped and outside the truck talking to other people how can I be at the controls of a cmv? ( On duty I can agree with, for the readiness reason you claimed)

And as for traffic, we are talking I696, which is a fairly short strip of expressway in Detroit. It's easy to go around....
And again, adverse driving conditions is exactly why that is part of HOS.

 

Okay fine. Nobody "plans" for this or any other incident that closes the road. When it happens? you deal with it. You go into violation? You and the carrier note the unusual event, accept it and move on. There will be no firing squads and no terminations. It's not the end of the world. It's not that complicated and it's not that big of deal.

I would initially log it as line 4. If it lasted more than 2 hours I may change it to line 1. Either way if I run out of time right there I am continuing on to the next place to park. To hell with what the elog or be a bit late for a delivery I would call this a legitimate excuse.

The dot is not looking for offenders like this. They are looking for people making conscious decisions to operate outside the law. Now unless on your next inspection you start off with something along the lines of "what the F do you want??" I would expect nothing more than a brief explanation for the HOS violation to suffice.

I have ZERO patience with those crybaby "look at me" public attempted suicide jerks.
