Let’s say my truck breaks down in the middle of the highway and I couldn’t pull over without risking driver’s safety in the other lanes. I put my flashers on and I call emergency services. Before someone can show up someone hits me from behind. Would that be a DOT on me even though my company just gave me the truck not too long ago?

If you can't move the truck I fail to see how it would be your fault. However, in trucking it's commonplace to blame the driver for anything under the sun.

I don’t see what the length of time of getting your company truck has to do with anything. You clear the truck as being roadworthy prior to your driving shift.
But yah, you could end up with an accident on your psp. Your company score will take a hit. Accident with fatality being the worst. Accident with injury, and tow away are others placed on your company.
Your question is quite vague so I’m just throwing things out there.

Hypothetically, if you are traveling at 45 -50 mph or higher, there is no reason you couldn't get 90% of the vehicle out of the travel lanes. That is what keep right except to pass means.
Now, if you are in slow moving traffic and your unit quits, you would end up in a travel lane, but keep right, except to pass means you are broke down in the right lane.
And lastly, WHERE ARE YOUR TRIANGLES? You never mentioned them. They are there to protect your rig if you are a traffic hazard.
First turn on your 4-ways, second get out your triangles a place them in their required positions, then call breakdown.

Well, if your hypothetical trailer was hit by a hypothetical car, and that hypothetical car diver died, they COULD hypothetically get you for a hypothetical manslaughter charge, hypothetically. However, hypothetically you would probably be able to beat that hypothetical charge, at least hypothetically......

If my truck was stuck in a travel lane and I had put out my triangles, I would walk to the grass shoulder, walk toward traffic 50-100 ft and wait for the cops I called by dialing 911. All of the debris from the crash is going with the flow of traffic, not upstream of the point of impact.
